FLR (M) Questions - Unmarried Partner Application

Post by agpour » Wed Aug 14, 2013 5:15 pm

Hi,

I have few questions regarding my application for an Unmarried Partner Visa and I would appreciate if someone could answer one or two.

Background:

I am an Iranian national currently on PSW(Post Study Work) Visa which expires in October. I have been in a relationship with my British partner for over 3 years and have living with my partner for 2 years and 7 months now. I have been working as a freelance photographer (sole-trader) and my partner is a teaching assistant (2 years + working at the same school) . Last financial year my profit was £6525. My partner salary is £16830. We do have £22000 in savings as well.

The documents that we are attaching are:

Joint bank account statements (Opened in February 2013)
Joint tenancy agreement (Starting from 24 January 2012)
Home insurance (Joint names from November 2012)
Council Tax Bill (Joint names for 2013-2014 statement, previous statements are lost)
Personal Bank account statements
Electricity Bills (under my name)
Water Bills (under my partner's name)
Tax Return forms (mine) and payslips (Partner's)
Phone contract ( under my name)
Work contract (my partner's)
Holiday's booking confirmation and photos

I was wondering in terms of providing the evidence of a genuine relationship, are the documents above enough? or what else can we provide to make it a strong application?

Also, in terms of financial requirement, Does the financial year I use need to be the last FULL one only ? (i.e. Apr '12 - Apr' 13) or does it need to be (Apr '12 -April 13 + April 13 to present date)?

Also, My partner's salary is stated as £16800 Per Rota in her contract (Per Rota means that she doesn't get paid for school holidays or summer holidays). I have added her payslips up for the past 12 months and it does come to £15730. Should I put £16800 as her salary (As stated in the contract) or the actual £15730?

Any answers and help is much appreciated.

Thanks

I am applying for an Unmarried Partner Visa (FLR (M)) and I have a few questions regarding the Section 7A.

I am combining my earnings (self-employed) from last financial year and My partners earning from Salaried employment.

My earnings from last financial year was £6525, and my partner's (according to P60 for same period) were £12600

My partner has received a new contract (with raise to £15000 effective from August). My question is:

For my partner in the section Income from Salaried Employmment:

section 7.3: Income from salary employment (Partner) , Current annual Salary Box, should I put my partner's new salary according to her new contract or her earnings according to P60 for last financial year?

7.3A (V) What date your sponsor commence their current employment?

is this from September 2011, or August 2013? (As she has been on two different contract with the same employer)

7.3 (xiv) What is your sponsor's annual income from their employment before tax?

again, do I need to put her new salary or her salary in the last financial year (According to p60)?

Any help is much appreciated.
Thanks

The current annual salary should reflect what the employer will write.

In the guide it does state, Income from salaried employment if combined with self-employment earnings, it must be during the same financial year. The confusing part is that her earnings are different in that financial year (she was on a lower income) to the her current one (as she has offered a new contract with higher wages), so would I put the financial year earnings (to comply with the guide for same fiancial year period) or her current salary?

When combining cat F or G with Cat A or B it would appear that the financial requirement must be met in the relevant financial year. So the person would need to earn the amounts in the same period (the same financial year).

Thanks for your reply, so for the salaried from employment fields, anywhere that asks for current salary/ current salary before tax I should put my partners earning during the financial year (according to p60) and not her new salary? Do I need to explain the situation in the extra information page?

You should state everything as it was during the relevant financial year and include salary slips from the relevant financial year until now. The employer letter will have to be as the earnings are now.

I am applying for an unmarried partner visa and I want to double check to see if the following documents are enough to provide a genuine relationship akin to marriage: (we have lived together for over 3 years and the following documents cover the 3 years)
Joint Tenancy Agreement
Joint Bank Account Statements (6 Months)
Home Insuarance Policy (Joint)
Current Council Tax Letter (Joint)
Personal Bank Statements (2 Years)
NHS Letters
HMRC Letters
British Gas and United Utilities Bills
Letter from UKBA
Holiday Confirmation Email
A couple of photos

Is that enough to prove our relationship is genuine and akin to marriage?
Any help is much appreciated.
Thanks

I have already paid for the premium appointment in full, should I fill the payment details page?

1.13: Passport Issuing Authority? (It is not in the passport)

1.17: Please Give Details of any previous passport covering the last 10 years, including where these are now?

I have 1 expired passport, should I just put the passport number in the filed, and what should I put for where these are now?

6.5 How do you keep in touch with your partner? we live together and keep in touch via phone calls & Texts.

6.9: "Have you lived together permanently in the UK with your sponsor since your last grant of limited leave to remain as a partner?"

I have lived with my partner for the past 3 years but I haven't been on a partner visa. so the answer is no?

Any answers would be massively appreciated.
Thanks
