Does my Partner need FLR

My wife and I got married in February, at that point I was a Tier 2 work permit holder and my wife was given a Tier 2 dependent visa. I was eligible for my ILR this month which is August 12th and I got my ILR granted on the 16th. Now I got know thatmy wife must shift from her her Tier 2 dependent visa to a FLR in order to meet the ILR requirements or if she leaves out of the UK she cant enter again, but the rules changed in July 2012 that the partner visa is extended for 5 years and some one told me that she can remain on this visa till end of the three year term that she has got and also she can then extend her visa to meet the ILR requirements. My confusion is can she remain on the ILR, 2. if she goes for a holiday or a visit anywhere out of the UK can she re-enter with the same visa. Please advise if she has to change to the FLR or not, based on the new changes to the spouse / partner visa regulations which came into effect in July 2012.

Did you qualify for ILR as a PBS applicant or Long residence? I assume that it was PBS, in such case your wife can keep extending as a PBS dep until eligible to apply for settlement [Set(o)]. This will be 5 years if she became a PBS dep after July 2012.

Hi Amber my wife got her Visa after July 2012, she got her PBS dependent visa in June this year

So she could just keep extending when necessary as a PBS dependant until such times as she qualifies for set(o).
