Continuous absence period for ILR from Tier 1

Post by 2013ilr » Mon Aug 19, 2013 9:57 pm

Request for guidance and clarification for ILR application.

My situation – I was in work permit for 3 year until 2009, and I am currently in Tier 1 for the last 4 years. During my Tier 1 period I was continuously out of the country for 5 months (152 days). Hence couldn’t able to apply for ILR on five year category. (As more than 90 days continuous absent was not allowed).
1. Has there been a recent change in the continuous absent period from 90 days to 180 days under 5 year category. Is that applicable for me.
2. If yes, do I need to provide any supporting document for this absence and what type of document?

Any help would be much appreciated[/b]

1) If I stay more than 180 days can I go under 5 Year scheme. Also looking into the SET(O) form for other Tier 1 category like investors Section 9 H H1. it is mentioned that I have not been absent for more than 180 days in any 12 consecutive months during the specified period of continuous leave.
the above sentence is not mentioned in the form for tier1 general category. can anyone please share your idea?
