My ILR has been approved and have just received my BRP. Thanks for everyone on this forum for their comments and advice.
I hope my case would be helpful for some of you who have been in overseas employment.
Highlights of my situation:
1. Only did overseas employment for 5 months in the past one year: It’s overseas employer, overseas payroll, overseas bank account and overseas taxes. (although I did pay UK taxes on these overseas earnings when I returned, which is key to my application)
2. No UK employment for the entire one year shown for the earnings period (hence points for UK experience is 0)
3. Absences are mainly to work for this overseas employer outside the UK (so the absences had nothing to do with UK economic activity)
The PEO appointment clearly mentioned that any cases with overseas employment will not be given same day decision due to further verification requirements. But I believe the proofs (especially the earnings documents as I’ve submitted around 4-5 proofs rather than the usual 2 proofs) I’ve submitted compelled them to give me the approval within 2.5 hours. Please find below the documents I’ve submitted:
-SET (O) application + PEO appointment letter + Passports etc
-LIUK certificate
-Earnings: (I’ve concentrated my entire application time getting all these documents sorted as mine are overseas earnings)
1. Letter from Employer confirming the amounts and dates paid for those 5 months
2. Electronic payslips (signed and stamped)
3. Overseas Bank statements (signed and stamped)
4. Overseas tax documents (signed and stamped)
5. UK certificate of residence from HMRC (to confirm that I am a UK resident for tax purpose for the year I am claiming my overseas employment)
6. HMRC letter: confirming that I’ve declared all my overseas earnings for this employment and I’ve paid UK taxes on these earnings
- 3 months bank statements for funds; also these are a combination of UK and overseas bank statements (the new application did ask for 3 month bank statements, but no minimum funds requirements)
- Absence letters:
1. Letter with all the absences list (total 140 days in 5 years: 100 of which are for this overseas employment in the preceding one year, but not in one stretch)
2. Letter form overseas employer confirming that these absences were for that employment
3. Letter from UK employer (for the remaining absences) confirming that I was entitled to a 28 day/annum paid leave
4. Communication for airlines confirming the disruption of the services for a couple of absences (not at all necessary, but submitted them anyway)
-Finally I did submit a letter describing my employment situation (which I believe has supported my application strongly). I am a Research Scientist by profession, therefore I’ve explained my situation confirming the delay in getting jobs as it will take a considerable amount of time to get into a job in my line of work. I did submit a considerable set of past interview letters and a couple of future interview invitations (they’ve retained all these letters interestingly along with the absence letters)
My PEO was at Solihull and no interaction with case worker what so ever.
The whole process took around 3.5 hours.
