Has anyone got ILR with absences more than 180 days

Post by ILRGeneral » Wed Aug 21, 2013 12:29 am

Hi,

I would like to know if anyone has got ILR with absences more tan 180 days.

I have one year (penultimate year) with absences more than 180 days; I have taken care to split the leaves across years and after which one year still fails with the deviation by around 20 days or so.

I have been in UK since 2005 but had a break in work permit in the third year and could not apply for ILR in 2010.

So the 5 year clock again started in 2008 fag end but I now see that there is one year which still deviates on the 180 day absence rule. All these absences are work related and I was paying tax and NI for all these days as my salary was getting credited to UK bank account. Have proofs of NI, tax etc.

Has anyone got ILR with deviations to 180 days and with salaries being paid in UK during that time.

Thanks in advance.

Hi All,

Putting down my absences across years here. Request if anyone has got any suggestions or advice.

(Days Absent 0) 30-Sep-08 30-Sep-09

(Days Absent 42) 30-Sep-09 30-Sep-10
26-Oct-09 7-Dec-09 26-Oct-09 7-Dec-09 42 Annual Leave

(Days Absent 168) 30-Sep-10 30-Sep-11
3-Dec-10 28-Mar-11 115 Assignment in India
3-Aug-11 25-Sep-11 53 Assignment in India

(Days Absent 208) 30-Sep-11 30-Sep-12
24-Oct-11 12-Nov-11 19 Assignment in EU
14-Nov-11 21-May-12 189 "Assignment in India,
Compassionate Reason - Death in the family"

(Days Absent 59) 30-Sep-12 30-Sep-13
1-Nov-12 30-Dec-12 59 Annual Leave, Assignment in India

Concerns as mentioned in another post:
(1) How good are the chances to go through ILR with these absences?
(2) No sufficient documentation to prove the stay, for around 8 months stay, in UK apart from the stampings in Passport
(3) One week of payroll overlap between companies during the move to current company.

Request for any suggestion(s) or advice.

Thanks & Regards

Assuming your case isn't assigned to a foolish caseworker, what do "you" think your chances are?

Hi,

I would have been in a good position to answer your question had I applied for it earlier and had been rejected/approved.

Anyways, thanks for the reply.
