when to apply for british citizenship?

Post by shvi » Sat Aug 24, 2013 10:17 pm

Hi
I came to UK with spouse visa on January 2008. Didn't apply for ILR on 2010 due to some financial issue and overstayed. I've applied for ILR on December 2012 and been approved on March 2013. My spouse is British Citizen. Please someone tell me when am I eligible to apply for British Citizenship?

When did you overstay? What periods?

Was the ILR application set(m)? If so, this is good to see that they allowed your ILR given that set(m) doesn't require extant leave. If this is the case perhaps a brief post of your experience could be given? :D

Given that your breach was more than 6 months its unlikely that discretion as per paragraphs 2 and 4 of Schedule 1 to the 1981 Act would be applied. Therefore, safe bet may be to apply March 2016.

Hi,
Thank you for the reply. I'll apply after march 2016.

I am a Canadian citizen.

Well, in my case we know each other more than 8 years and he has visited to Canada more often to spend time with me.

Due to financial struggle we couldn't apply on time.

Tried to apply via solicitor but couldn't able to go with their demanded fee on top of visa fee set(m).

I've applied via postal application with a cover letter explained the reason for late application and lots of supporting documents proof our relationship is genuine . Then within a month I've received bio metric invitation letter and within two months received ILR

:D

Thank you

Very good to see that you were awarded set(m) after such a long time, although you were legitimate in your claim, we do not see that many with such a delay.
