Travelling outside UK with previous leave

Post by nadeem toheed » Sun Aug 25, 2013 11:25 am

Hello all Members

Could you please answers
I (the Main applicant) have been granted ILR on the basis of ten years long residency as my previous leave were valid until 31st July 2014. And my dependent(Spouse) had a Tier 1 (PSW) status up till 31st July, 2014 , I am planning to go to Pakistan in December 2013 and wants to come back in January 2014 (for 3 to 4 weeks )
My questions are,
1- Do I need to change my wife status on spouse visa like FLR (M) before travel to Pakistan?
2- Is there any harm to live and leave the country for holidays without switching on spouse visa and living on previous visa in UK (PSW dependent)?
3- if we leave the country on previous visa (PSW dependent) and come back than is there any issue on arrival to UK?

Thanks

The rules may change (for a PBS dep spouse where the PBS applicant was not on a route to settlement) at any time so I would get your wife settled now rather than later.

See also, your previous thread.

Thanks for your reply,
I just post this as i was planning to go to Pakistan in December this year so i thought , not to extend her leave as she had a vaid previous leave untill 31July 2014 and now (save the FLR(m) ) fee and when came back from Pakistan than apply for either FLR(m) and than ILR (as you suggested)
Thanks for your help

I believe your partner's PBS dependant leave will become invalid if she travels outside the Common Travel Area because you have not been granted indefinite leave as a PBS migrant, but under LR (319C(b)(iii)).

I never said to wait, if anything I would be inclined to say get it done now before the rules change.
