Indefinite Leave to Remain - Wife on 2 years VISA

Post by harv » Sun Aug 25, 2013 4:31 pm

Hi Guys

I have been away from this board for quite some time now, been a bit too busy at work and this site is also blocked there :(

So now I am back for some help from the experts as always.

Situation:
Wife got a Spouse VISA on Mar 2012 (so pre July 2012 changes)
I am planning to apply for her ILR in Feb 2014

Requirements for the VISA (I think but not entirely sure, so need your confirmation).

- IELTS level 4+ (or ESOL not sure) [She did IELTS and scored 4+ in Dec 2011 but would be considered expired by than].
- Life in the UK, LIUK
- Finances, should it be around £110 weekly or £18,600 per annum rule?
I am a director of a limited company and the accounts wont be submitted to HMRC at the time of ILR application
- Accommodation as standard
- 6 different documents from two years to show my wife and I have been living together

Hope someone can help me with the above queries.

Thanks
Harv

I assume your spouse was granted a spouse visa when you were settled/British so you'll be looking at a set(m) application.

Under the old rules it's adequate maintenance and accommodation so no set requirement per se, but rather that you can maintain without recourse to public funds, so, Net Income of roughly £112.55 or more per week after deducting rent.

The new English requirement will be at the level of B1 (wait for the guidance released after 28-Oct-2013), IELTS expires after 2 years I believe, KOLL will be satisfied with her LIUK test.

Yes cohabitation documents should be one joint letter or a letter each for each 4 months of the 2 years from a total of at least 3 different sources.
