My husband applied for leave to remain in the UK based on the fact that he has a child who is EEA. His application has been refused by the home office saying that the child is not British. He has been given a right to appeal. He has a contact order from court to see this child once a month.

I am on the Tier1 General visa due to apply for indefinite leave to remain in October 2014. I have two children with my husband who were born born in Canada. Can he base is appeal on the fact that he has a wife who is legal in the uk and has two children with me he has to support. Also that he has a contact order from the court which he has to fulfill.

Please senior members i need your help.
