British citizenship

I am Bulgarian nationality with Permanent residency status in UK.
Since Bulgaria joined EU in January 2007 I have applied for Blue
Registration Certificate which gave me a right to work and live in UK
without any restrictions. Previously I have been working legally since 2003 on work permit basis.
I would like to find out if I am already eligible to apply for British citizenship
considering the fact that since January 2007 are 5 years already exercising European Treaty rights and one
more year until January 2013.
The main confusion comes from the fact that I also applied for Permanent residency in 2012 although I was
not obliged to do so as the status comes automatically.
I have received the card on 31th of October 2012 and when the home office consider my application if they count 12 months
from the date Permanent residency was issued that could cause argument and possible refusal although my
entitlement arises as soon as end of October 2013 after January 2013 when completed 6 years.

Could you please give me an advice before I submit my application

I am trying to obtain this information for months from Home office and citizen advice,but unsuccessfully.

Your help would be greatly appreciated

You must have been settled 12 months if you are not the spouse of civil partner of a British Citizen. It is easier to show that you have had PR for 12 months by just showing your PR but, you may have had PR before this point as you attain PR automatically. Bare in mind that if you apply post 28-Oct-2013 then you will have to satisfy the New English Language requirement in addition to the LIUK test or equivalent. You seem to have been eligible to naturalise since Jan 2013 by sending the same proof as you used for your PR application (exercising treaty rights since 2007 with permission to work) so far as you meet the other standard requirements.

BTW - If you were working legally in the UK before 2007, then that time is also considered part of the 5 years exercising treaty rights (even though Bulgaria only joined in 2007) so you could have probably applied for naturalisation already in 2009. See more details in PR requirements changed for A8 and A2 nationals : ECJ ruling.

Why do want to become British? Are you aware that by becoming British you will not be able to use the EU immigration route anymore and would be subject to the (more strict) UK immigration rules in case you wish to bring (non EU) family members to the UK?

Hi! Guys,

I'm in the same situation; also EU, except that my country joined a lot sooner than Bulgaria; I only applied for the PR card in March, but I emailed the HO and they told me that as long as I can prove with P60s / letters of employment / payslips that I've been working for the last 6 years continously; I can apply; the card only proves that you have permanent residency, but it doesn't determine when you acquired it; treaty rights do.

I also heard about the stricter sponsorship router to bring non EU people if you are naturalised, but I'm not planning on bringing anyone; my relatives are all EU and not planning to move here anyway, so that wouldn't affect me, so good point for those planning on bringing non EU people.
