Employer Reference letter for ILR - Tier2 ICT

Post by tvnaveen78 » Sat Aug 31, 2013 12:29 am

Hi
My employer doesn't entertain ILR so they are not in favour of giving a reference letter for this purpose. They do provide a letter with all the required details mentioned in the template for ILR letter including SOC but below they mention the purpose of the letter is for processing of VISA for his parents...something...like that.

My question is whether this letter can be shown as a reference letter from the employer.... Any experiences shared would be great.

Regards
Naveen

Looks like you are from TCS . Have seen many cases like this in this forum. In some letter it was mentioned home lone / study etc and all have been successful.

Below are my VISA Details

Can you please let me know whether I am eligible for ILR

20/07/2008 - 12/07/2010 - WORK PERMIT
12/07/2010 - 26/01/2012 - T2 INT COMP TRAN
10/02/2012 - 27/01/2013 - T2 ICT LONG TERM
10/04/2013 - 26/07/2014 T2 ICT LONG TERM

I have just now spoken with croydon call centre and they say I am not eligible as T2 INT COMP TRAN switch didn't happen before April 2010. And also they say that I wasn't switched to the established category.

So can please some one help and I am in total panic.

Hi Amber

Can't really interpret this bit.

(d) The continuous period of 5 years referred to in paragraph (b) must
include a period of leave as:
(i) A Tier 2 (Intra-Company Transfer) migrant granted under the rules in
place before 6 April 2010, or
(ii) A qualifying work permit holder provided that the work permit was
granted because the applicant was the subject of an intra-company
transfer.
A qualifying work permit holder is a work permit holder in either the
business and commercial category or the sports and entertainment
category, provided their work permit was not a multiple entry work permit

I had the Work permit as multiple entry visa. But can someone help me out. I work for TCS and all the workpemits are multiple entry VISA Work permit.

Please help me out

Hi tvnaveen78,

I believe unfortunately you will not qualify. However I will leave the final decision to the gurus

Good luck
I try to give honest answers, however I might be wrong, kindly always check with your solicitor/accountant for final confirmation

I have my friends in the same company who have applied and they had got their ILR done. Can't really understand? And they did switch to ICT after April 2010 as the company did extend for them as well at the same time.

The 5-year continuous period must include time spent as:

a Tier 2 (Intra company transfer) migrant under the Immigration Rules in place before 6 April 2010; or
a qualifying work permit holder, provided that the work permit was granted because you were the subject of an intra-company transfer.
If it is not a qualifying work permit then you will not qualify. I suggest you email: settlementopspolicy@homeoffice.gsi.gov.uk and ask them whether a PBS applicant on a work permit (state the exact type) which was subsequently switched to T2(ICT) after April 2010 would qualify for ILR after 5 years? It sounds like you got the work permit as a ICT which would therefore qualify you.

On my work permit it says replacement of a previous workpermit issued in 2003. I was in UK from June 2003 to 27 Dec 2007 on previous work permit and later on had to go back to India.
Then I came back on 20 July 2007 work permit issue date was 30 June 2006 on this one it says its a replacement for the old work permit. Does it mean its a multiple entry Work permit?

Check, back of your work permit either point 9 or point 10 says how to identify multiple work entry permit and sector based work permit. If its multiple entry work permit it would have marked at top left corner of work permit.

ILR Granted today for myself and my child. Didn't apply for dependent. But the case worker did ask why I didn't apply for her. She said it would have been good if you could have applied at the same time. Now planning to apply for her ILR.
