Confused re spouse visa application forms

Post by mbf » Sun Sep 01, 2013 8:34 am

Good morning,

I've been married to a British Citizen for 9 years. We have never lived in the UK together but have now decided to move back to the UK when our employment contract expires in 2 months.

I'm completing the VAF4A Family Settlement Application Form and the Appendix 2 Financial Requirement Form. Howerever, they both: 'you should complete this form if you wish to come to the UK as a spouse of someone settled in the UK. We have not lived there for duration of our marriage and do not own property in the UK.

Am I completing the correct forms or should I be doing something else?!

Thank you in advance.

It's correct, remember you'll need to show:
The ECO should be satisfied that the accommodation complies with the following requirements:

it is (or will be) owned or legally occupied for the exclusive use of the couple (see definition in section below); and
it is capable of accommodating the couple, and any children, without overcrowding as defined in the Housing Act 1985 (see MAA134).
So I assume you have accommodation all set up?

For financial requirement, not sure how you are satisfying this, whether you are using savings or that you have a job offer in the UK?

Thanks for your reply.

At this point, we have no home set up. We were planning to reside with inlaws before renting a place. We need to research schools before committing to an area.
Furthermore, husband has no job lined up - we are in need of a well deserved few weeks off before working again.

So can I just confirm, we need accommodation set up prior to making the application and we satisfy financial requirement with savings OR confirmed employment?

Also, the application forms I was completing are the correct ones, despite husband/sponser NOT being settled in UK?

Many thanks for the assistance.
