ILR Employer Letter - Employer unwilling to mention SOC2010

ILR Employer Letter - Employer unwilling to mention SOC2010

Dear All,

I have my ILR application in next few days , And im in bit of a situation here.

My Employer is willing to mention everything in the ILR letter except the SOC 2010 job code. I have made every effort explain this new requirement & The HR is totally reluctant to give this saying it will be compliance issue and they cant do that, as My COScwas issued before Apr 2013.

The Employer has mentioned all other things in the ILR letter - like SOC 2000 code & job title as per my current COS which I got in 2012 valid until 2014, my salary & that the salary is paid in line with T2 codes of practise , that Im still required for the job, Absences confirmation, Request you to Grant him ILR etc. But not ready to mention new mapped job code.

Will this be enough for ILR application?

I know many others are in same boat as me , so has any body got ILR approved based on the SOC 2000 job code in ILR letter?

My ILR PEO application is coming up in few days and Im extremely worried.

Hi, Forgot to mention in my post that - My salary is above the threshold for nearest matching SOC2010 job code's experienced category.

I have seen 1 successful case with SOC 2000 job code(Can't find the link though). SOC 2010 contanis old code also for mapping . Get a letter from HR why they can't issue letter as per SOC 2010 and produce it if CW questions it .
Can't you ask him to mention both ?
e.g.
SOC Code XXXX(SOC 2010 YYYY)

Yes I did try asking the HR to mention both codes if not new, but they say that they are'nt in position to help with the new SOC codes in ILR letter as COS was issued before the SOC 2010 was introduced. And it will be a complicance issue.

I also asked for letter confirming why they cant mention soc code , and they disagreed to that also.

Im really worried :-(

Don't worry . Write a cover letter explaing your situation and also hardcopy of mapping page(SOC 2010) for your code and discuss with case worker but only if they question it.
In my opinion you will be fine.
