arguments against refusal

Post by razz11 » Fri Sep 06, 2013 2:35 pm

Hi,
I have hearing date on 1st Oct. My tier 1 entr visa was rejected on 3 points:
1 - My job title (Financial Consultant) does not match with the services I am providing (which i mentioned in my business plan and contracts). Actually, the services match more or less with the job title of "Financial Manager" but i didn't read the description of Financial Consultant when i was filling my application form as i was running out of time. My idea was that everyone who is a freelancer/self employed promotes himself as a consultant/advisor in the market (like IT consultant, Engineering consultant, Business Advisor etc.) so I didn't even looked at description of financial consultant.
2 - Email address and landline number of my clients are not on contracts.
3 - My company website doesn't have my name on it.

Can anyone advise if they have gone through the hearing process and had similar objections and what did they argue on and have won or are confident that their points are god enough to win the case ?

Also, will they ask me about other stuff apart from these objections or HO representative will argue on the objections only ?

Thanks for helping me.

what you do in papers does not match with what you actually do is funny because you should know what you do before anyone else..
however give it an add on of what you do in papers in additional to what you actually do it will be an enhanced list of services that you provide.
if they say you have not provided your name within advertisement materiel you should know why you did that if you follow the policy its the requirement you should not have set aside. you need to add an additional page to your website where you mention the services and your name in the bottom who actually provide the services they might argue I forgot to enclose this page with my other documents but the page with my name on was still on my website and also you can have your name printed on flyers/leaflet because they wanted your name mentioned as a who delivering the services again you can say I forgot to enclose when I posted off my application.
you need to arrange more contracts with all contact details as guidance stipulates about the one you already provided it can be said this client does not have land line or the email it could be a real problem but following immigration law and the policies you need to arrange more contracts stating all those details a contract should have..
thanks

I can understand all the concerned but this is not the best way to lie because the more you will appear in the court with clean hand, the sooner you will get relief but the more you cheat the court, the sooner you will be kicked out.
Experience and understanding can get you to the goal.Every information based on my own experience is friendly shared in goodfaith.

I attended 2 hearings on Friday just to observe and the judge allowed me to sit at the back. The first hearing was against a T1 refusal and my God the appellant and his representative were just SHOCKING!

Presenting officer asked him why he had no land-line, invoices, nature of his business (IT). The judge also asked him if he has been paid at all while running this business! His response to this questions -I cannot even bother typing them.. Judge said he will go and consider the case and get back to him within 28days! I think everyone in the room knew that case will be dismissed.
I wonder why he came with a rep.. she had no clue what she was doing.

You should prepare yourself adequately if you're going for the hearing! Know your numbers, finances and have solid reason why you should be allowed to carry on doing your business! You're investing in the economy and should be confident of yourself.

@top .... thanks for your elaborate and thoughtful advice ..... to be honest, i know what services i am providing but i followed what people normally do in the market when they work as self employed .... i.e. they call themselves as consultants or advisors .... i didn't go through SOC description of a "Financial Consultant" as i thought it covers a Financial Manager's role as well (which is what actually describes my role) .
About website, though i submitted my business cards along with the application where i actually did mention my name, but i didn't mention my name on company website because of 2 reasons .... first because it is a website to represent a company, not me ... secondly, because people only provide names of the management of an organisation on the website .... I felt it as a bad marketing idea because i am the only person so far working in my company so whoever will visit the website may think of it as a one man company.
I never made the contract letters in the first place with an idea of getting a visa ... i made them as per my client's consent ... they didn't wanted to mention their email/phone number on the letter (though I have them in my personal diary) .... I have explained them the situation now and they are willing to provide me covering letter in support of my application ....

@choc-ice ..... thanks for the advice .... by numbers and finances you mean the projected revenue/profits ???

what you think people if these points sound valid enough ? i honestly had these things in my mind when i was documenting my visa application .

I will really appreciate and be grateful if someone can give me any insight .
