Its very strange that UKBA will do this, when an appeal is pending.

They have dealt with your application. No application is outstanding.
The matter is going through the Upper Tribunal as an Error of law.

Only the error of law will be addressed, if there is indeed one.

If the upper Tribunal deals with your appeal, he will only address whether or not the marriage certificate was valid.

The cannot now seek to find further reason to refuse, by calling you to attend an interview, when no application is pending before them.

Thanking you so much for the reply. As at the moment, I am in a limbo as to what to do as this has almost costed me my marriage as I have not been working since last year and now my housing association has sent an eviction notice. Do you think I should contact my local MP for help or what advice can you give me. Thanking you for a reply
