Hi there,
I would like to ask some Question about to apply MN1 form outside uk for my son.
He is 4 months old and born in Japan and he has Japanese passport(never been uk). He is stay with my wife in Japan now.My wife is japanese and has spouse visa and will expire april 2014.
I live in uk, I m British citizenship by descent (was not absent more than 270 days)and my dad which is baby grandparent is otherwise thanby descent.I read though the guide. I believe he is quafily to apply the British citizenship.

My Question is. Can I apply MN1 form for him outside uk to get citizenship or I should apply the spouse child visa to make him come to uk first then apply MN1.

Looking forward to hear your advise

It is possible to make the application while the child is abroad. However, in that case, the child will be British by decent (applying under section 3(2)). It might be better for the child to spend 3 years in the UK (with a child settlement visa) and then apply for registration under section 3(5). This will entitle him British citizenship other than by decent (so he could pass it on to his children if born abroad).

Are you aware that Japan doesn't allow dual nationality and by becoming British he will lose his Japanese citizenship?

Thanks for your reply. I already check Japan citizenship. He need to chose one of ciitizenship when he 18. So it will his option.

May I ask 2 more question?
On MN1 Form Section 1.3
Please say if and when the child was given indefinite leave to enter/remain in the UK. If the child’s parent is an EEA national, a Swiss national or a family member of an EEA or Swiss national you should ensure that they
qualify for permanent residence. D D M M Y Y Y Y
Child has indefinite leave to enter/remain in the UK. Date granted

For my case. Shall I just leave blank on this part ?because my son just new born and doesn't have indefinite leave to enter/remain in the uk

Last Question.
I have to proof I was not absent more than 270days.but I m selfemployer. Don't have any work letter from the company? What another doc I should provide as the best option?

1.3 - just leave blank.

I'm not sure you need to provide documents to prove residence other than a passport but any official letters would do (HMRC, DWP, NHS). You don't need to prove every day of the 3 years period.

I think it's better to wait 3 years and apply for citizenship other than by decent.
