Cancel - ILR visa for wife

Hi ALL,

I am having some difficulties with wife.

she is planning to make a police complaint in India against me and my sister.

She is also demanding her ILR visa card from me.She already took her passports and son's passport [ british passport].

Can you please let me know the process to cancel her ILR visa or any other process to defend my self in U.K if she makes same soft of complaints in U.K.

Note : I and Myson are biritish citizens and she is on ILR.

Indefinite leave provides permission to stay in the UK permanently and to be free from immigration control. However, in specific circumstances, indefinite leave can be revoked, or invalidated or can also lapse.

This is when a person:

► is liable to deportation or administrative removal but cannot be deported or removed because of the UK’s obligations under the Refugee Convention or the European Convention of Human Rights (ECHR) (ILR is revoked);
► has obtained leave by deception (ILR is invalidated);
► is deported or administratively removed from the UK (ILR is invalidated);
► ceases to be a refugee because of their own actions (ILR is revoked); or
► remains outside of the UK for more than two years (ILR lapses).

if she stay out for 2 years or else you can't stop her coming here but you can make a complain to the Police that's all. And you can dispute the matter in the court

I assume she has settled under SET(M)?

You can't cancel her ILR, once she has been resident in the UK for 3 years she will be eligible to naturalise as British whilst married to you. You should give the BRP to her as she may involve the police to get it back, and it's not worth the hassle.

. You will need to see a copy of this, or any communication related to this, from the court. Until then, she is just 'planning'. Also, why would this 'police complaint' be filed in India?

She is also demanding her ILR visa card from me.

You might be in wrong for possessing her ILR visa card.

She already took her passports and son's passport [ british passport].

You need to seek legal advice on your son's passport. Your statement implies that she does not stay with you, or live at the same address.

This is more likely a family disupute situation that will require a family law practitioner involved. I personally don't see any wisdom or legal ground in seeking revocation of her ILR status out of personal dispute.
