ILR for Tier 2 holders

Dear All

I have been in this country since November 2008 under Tier 2 Intercompany Transasfer. I am eligible to apply for my ILR by end of this year 2013'. However my wife is in her Tier 2 Dependent visa since March 2010 and would like to know if I am allowed to apply for the ILR for her as well when I am processing my application form ?

Few says that the Dependent with Tier 2 will need to be in this country for atleast 2 years with no more than 180 days away from this country

Would anyone be able to help me on this regard ?

If she has stayed with you in UK for Two years then YES she can apply for ILR with when you apply for ILR end of 2013. If she came in UK on March 2010 and stayed with you untill now then you will be able to apply her ILR with you.

As far as this 180 days out of country concern as far as I know it doesnt apply to dependent (your wife).

Hi Amber

1. My wife was away from this country for close to 4 months after her pregnancy delivery to recover her health. Would it affect her ILR application ?

2. For my co-habitation proofs, the below are the ones, I have
a) Joint Bank account Statement for 2 years or more
b) Tenancy Agreement for 2 years or more
c) Council Bills for recent 1 year
d) Gas & Electricity Bills for recent 1 year
e) Water Bills for recent 1 year
f) Electoral letter from the council at the recent address, I am staying

Would these suffice ?

Kindly advice.

Should be fine. For cohabitation just give one joint letter or a letter each for every 4 months of the last 2 years from a total of at least 3 different sources.
