Indefinite Leave to Remain SET(O) Questions

Hi

I am planning to apply ILR for me and family. Kindly help with my queries;

• Can I apply ILR for my wife, she entered UK on July 2010. She was outside UK for 9 months. Do we have any restriction for the duration of stay in UK?
• Can I apply ILR for my daughter aged 1.6 yrs. She entered UK on August 2012. If yes, which form should I use to apply?

Currently both my Wife and daughter are on Tier 2 ICT Long term Dependant visa.

Please advise.

Dep absences should be limited and for good reason, I gather she was out for 9 months to give birth if so, that should suffice due to culture and family. All apply together on SET(O).

Yes my wife was out for giving birth. Regarding my daughter she sill haven’t completed 2 yrs in UK. Can she still apply along with us under SET(0).

Also one last query regarding my ILR application. I have completed 5 years in UK and was outside UK for total 200 days within the whole 5 years. But not over 180 days within 12 months. Will this create any issue? Should I provide any additional letters to justify this? Kindly advise.

All apply together. Providing absences do not exceed 180 days per 12 month period no evidence should be required.

I and my wife hold an professional Bachelor degree taught in English from India. We have a letter as well from our college (India) to confirm that our degree was taught in “English”

Please let me know if we need to still apply for UK NARIC certificate to confirm this? If yes, kindly suggest if we need to apply for “Statement of Comparability” or “English Language Assessment” certificate?

If you met a B1 EC requirement that should suffice in addition to LIUK.

If you wish to rely on an overseas degree then it may be necessary to get both the Statement of Comparability and English Language Assessment, although, the Statement of Comparability with proof it was taught in English should suffice.

Hi

This is regarding ILR (SET O - dependant) for my wife. She entered UK on July 2010 and she was outside UK for 9 months for giving birth + 62 days for holidays. Kindly let me know how to make the long absence (for giving birth) clear to UKBA during the application? Do I need to provide any additional letter to confirm this. Please advise.

FYI, I am on currently Tier 2 ICT and planned to apply ILR for my wife along with my application.
