Should be ok so far as:
you have met the residence requirements over the qualifying period; and
you have demonstrated a link with the UK by establishing your home, family and a large part of your estate here.

Thanks Amber,

What does it mean by meeting the residence requirements over the qualifying period and demonstrate link to UK. Will they accept bills with her name and UK address on it to satisfy this requirements ???

Thanks Amber,

So, the applicable paragraph for my wife's case is the following:

5.1.2 Total absences of more than 100 days but not more than 180
days where the residence requirements over the full 5(3) year
qualifying period are met - consider disregarding if applicants
have demonstrated links through the presence here of family,
an established home and a substantial part of their estate.

- Presence of family in UK: I am her husband living here and working. is it okay?
- An established home : I own a house here in UK but under my name only so my wife's name doesn't appear on the land registry or mortgage statement. Is it enough?
- what does it mean by a substantial part of their estate???

Thanks

An estate basically comprises of all your possessions. This could be money, shares, personal property and land and any other assets. If everything your wife owns was in the UK that would be her estate.

Thanks Amber,

The only thing under his name and my name is joint account with saving up to 18000. But other than that everything else in my name. Do you think that would cause a problem?
