EEA Residence Card & Absence

Post by marshallin » Thu Sep 26, 2013 3:28 pm

Hello

Appreciate if someone could guide me on following.

Husband: Swedish EU holds EEA PR card and has been in UK since 2001.
Self : Indian citizen and living in UK with him since Mar'12 and holding EEA Residence Card.

Understand maximum we can remain out of UK is 6 months per year
till the time I attain EEA PR ie in Mar'17. Is this interpretation correct?

Secondly considering nature of his employment there could also be periods whereby he would be absent from UK for more this 6 months whilst me being in UK. (He will maintain residence in UK and will be commuting every month). Does this affect my residence status?

Appreciate guidance

EU person with PR does not have to be a worker, self-sufficient, etc. They would generally only lose this after two years' absence.

Family members of such a person would accumulate time to PR as long as they live in the EU state together. Certain absences are allowed, generally up to six months.

Read directive 2004/38/ec carefully.
