Hi,
I want to know if I hold ILR and my children are UK born holding Indian passport and age less than 7 years, can we apply for UK passport and other process eg. naturalization from India currently they have Indian passport and I have to travel to India for atleast 1 year for urgent work and can't wait for 4-6 month for child UK passport, Indian Visa after that to be issued in UK.

Hi himpa,

I am sure its possible, but if you have time it would be better to:

1) Apply for naturalization using MN1 (3-4 weeks)
2) Apply for child passport fast track (receive in 2-3 days).
3) Then travel on their Indian passport (you can do that for 3 months after obtaining their british citizenship)
4) Get them back on British passport.

I think this is a much easier alternative, unless any experts can find some issues with this.

Hi,
Thanks for the reply.

If this can be applied in India then what is the process or any link/website that can mention all the steps then it would be helpful.

Since my stay in India will be for 1 year atleast so if I travel to India in Indian passport then after 3 months I need to surrender Indian passport can this be done in India as I have read I can't keep Indian passport or travel after obtaining UK residence else it attract penalty.

This can be done from India.

For Registration (1 above) - time scales are the same as you need to send the application to the UK the same way you will apply from the UK.

For UK passport, then I believe it takes 6-8 weeks from India for first (UK born) child passport.

No idea about the other formalities in India.

Do they have a UK visa in their passport? You can also apply for registration later (if fact until they are 18) so you can apply when you return to the UK.

thanks, yes they have UK dependent Visa on Indian Passport, as Visa will expire before they will come back to UK with us. My problem is how and on what VISA they will come back.

My child are born before my ILR.

Thanks, for the information actually I need to know two points-

1) thanks, yes they have UK dependent Visa on Indian Passport, as Visa will expire before we will come back to UK with us. My problem is how and on what VISA they will come back.

2) If parents have just ILR and child are UK born then we can apply for naturalization/Passport from India as stated by Guru's but I need to know if there is some other website/process or same as we follow in UK, since I could not find any information.

3) For child Naturalization is there a requirement for both parents to have ILR? Since if this is not mandatory then only father can apply for ILR and mother will not apply or will apply later.

1. If you have limited leave, then they may apply for dependant visas and their leave should expire in line with yours. If you have ILR, then they may apply for settlement visas.

However, their qualifying period for ILR in this category may be reset.
