Hi guru,

I am a new member and i have seen you are giving valuable advise to the members, thanks for that.

Now i am looking for your advise. i am applying for my ILR and alongwith me my daughter applying as dependant ( on or before 09/07/2012 rule applies to my daughter).

Soon after my ILR, i am applying for my wife FLR(M) because yet she didn't complete her 2 year period.

My doubt is:
My second child born in june 2013 and in the FLR(M) FORM, what i need to say in section-4 (4.1 to 4.9).

Could you please advise me.

It's not very clear I gather you're the spouse of a British citizen or settled person, confirm?

If so and your daughter is present she should apply for ILR with you. Your other child was she born in the UK? What was the immigration of you and the other parent when she was born?

Hi Guru,

Thanks for the reply.

I am the main applicant applying for ILR alongwith my daughter who have entry clearance under rules on or before 9/7/2012, so i believe she is eligible to apply for ILR with me as dependant, am i right.

when my second child born we both are not in settled status and now I am applying for ILR next month and soon after my ILR is cleared i will apply for my wife visa using FLR(M) FORM and will register my second child as british citizen using MN1 form.

In the FLR(M) form, in SECTION-4 BETWEEN 4.1 TO 4.9 LOOKS BIT TRICKY, could you please help me what I should mention, is it YES/NO.

Under what category are you applying for ILR? A pbs applicant or 10 years residence? When did your spouse arrive in the UK and what is her current leave, a pbs dep?

hi,

I am applying under Tier 1 General migrant category and my spouse arrived 8 aug 2013 and her visa issued from 4/7/2012. she is tier 1 general partner.

When does the pbs dep leave expire? She can apply after 2 years in the UK as your spouse, you should consider extending her pbs dep leave until such times as she qualifies. Alternatively, she could extend on flr(m) and apply for SET(M) once she qualifies.

hi,

her pbs visa expire on end of october 2013 (my tier 1 general visa expire same time).

I am the main applicant applying for ILR under tier 1 general migrant category alongwith my daughter who have entry clearance( as tier 1 general child) under rules on or before 9/7/2012, so i believe she is eligible to apply for ILR with me as dependant, am i right.

In the FLR(M) form, in SECTION-4 BETWEEN 4.1 TO 4.9 LOOKS BIT TRICKY and there is no notes left in the guidance as well. could you please help me what I should mention, is it YES/NO, i am so worried.

Your pbs dep child can apply with you by virtue of immigration rule 319J(e)(iv)

Section 4.1 is yes, 4.2, No, 4.3, No, 4.4, No then just state in 4.9 that child one has been granted ILR and child 2 is applying to register as British by virtue of section 1(3) BNA.
