5 Years Residential Query

5 Years Residential Query

Hello Guys,

A bit of doubt.

I was granted ilr last year in nov 2012 on the basis of hsmp (2 yrs ) + tier 1 (3yrs).

so now i would be eligible for naturalization this year in nov.

There's residential requirement which states

a) been resident in the UK for at least five years (this is known as the residential qualifying period); and

b) been present in the UK five years before the date of your application; and

c) not spent more than 450 days outside the UK during the five-year period; and

d) not spent more than 90 days outside the UK in the last 12 months of the five-year period; and

e)not been in breach of the Immigration Rules at any stage during the five-year period.


Now if I were to apply in nov second week via ncs, say 11th of 12th nov 2013 does that mean , as per point b) I were to be physically present in the UK on that date 5 years ago ? which would be 11/11/2008 or 12/11/2008 ?

I was on holiday / out of UK from 20/11/2008 to 25/11/2008, (5 days to europe.)

so if thats the case then either i need to apply before 20th of nov or after the 25th nov ?

can someone please guide me on this .

Correct. Just apply as soon as you qualify and get it out of the way.
