ILR set(O) UK ancestry questions

hi guys, please can someone help me with a few issues:

My scenario:
-currently on 2nd UK ancestry visa (arrived in 2004)
-first 4 years i had a massive amount of holidays
-last 5 years only one holiday over 90 days (compassionate reasons), and total less than 180 per year
-im owner operator of a small limited company (entrepreneur)
-applying for premium service

1. do i need to declare all absences from UK since 2004, or just the last 5yrs?

2. a) how accurate do i need to be with the SOC code?
b) should i choose CEO (my company doesnt have a board of directors)?

3. how accurate do i need to be estimating my hourly/monthly/yearly income, hours this salary is based on, number of weekly hours?
i've no idea as i pay myself minimum wage plus dividends, and conduct unusual hours of work.

4. Compassionate leave: i have letter from my sister in australia describing her daughters (my neices) rare disease and my requirement for moral support, leading to me being out of UK for more than 90 days. a) Is there any special terminology needed?
b) How do i prove my sister, who recently married and has different surname, is actually my sister?
c) do i need to supply original signed doctors certificates confirming my nieces rare disease, or is verified photocopy ok?
d) do i need to write a separate supporting letter?

5. i have UK ancestry, please confirm i do NOT have to:
a) complete the Points scoring system ?
b) supply document(s) confirming that you have spent a continuous period of 5 years in the UK:
c) recent payslip and 3mthn origianl bank statement. dated no earlier than one month before the application
d) evidence of your finances
e) if you are self-employed, you should provide evidence of the progress of the business.
f) document(s) showing that you are able to work and intend to take or seek employment in the UK.

6. what if i have not had biometric taken, will they do that at Croydon on the day of appointment?

An applicant for indefinite leave must meet the requirements of paragraph 192of the Immigration Rules. That is:

 continue to meet all the on entry requirements of paragraph 186 (i)-(v)

 have spent a continuous period of five years in the UKon the basis of UK ancestry

 have enough knowledge of the English language and enough knowledge about life in the

UK, unless they are under the age of 18 or aged 65 or over at the time the application is made.
192-SD Specified documents wrote:
The specified documents referred to in paragraph 192(vi) are:

A personal letter from the applicant which includes full details of the reason for the absences and all original supporting documents in relation to those reasons - e.g. medical certificates, birth/death certificates, information about the reasons which led to the absence from the UK.

im still not clear on these questions: :shock:

(ii) has spent a continuous period of 5 years lawfully in the United Kingdom in this capacity; and

(iii) has sufficient knowledge of the English language and sufficient knowledge about life in the United Kingdom, unless the applicant is under the age of 18 or aged 65 or over at the time of the application; and

(iv) does not fall for refusal under the general grounds for refusal; and

(v) is not in the UK in breach of immigration laws except that any period of overstaying for a period of 28 days or less will be disregarded; and

(vi) provides the specified documents in paragraph 192-SD to evidence the reason for the absences set out in paragraph 128A, where the absence was due to a serious or compelling reason.

I think you're getting confused. As far as I'm aware you'll just need the basics (passport etc), ancestry proof, 3 months wage slips and corresponding bank statements or accountants letter stating income and tax paid, LIUK, list of absences over last 5 years and if < 180 days per 12 months they shouldn't question it. Section 9 is irreverent for ancestry so you're just unnecessarily getting stressed for nothing. You should have no issues at your peo. Good luck.

this may make you laugh...

got a bit over-excited- saw an appointment for 25 Oct at Croydon (before the new english test comes in 28th Oct) and booked it super fast.
noticed something was wrong when the fee i paid was £953 (not £1436)
i booked and paid for FLR (O), instead of SET (O), :oops: (so dumb!!)
what to do?
i've completed the SET(O) forms and definitely applying for SET(O)
turn up and play dumb (naturally blonde!!!),
or cancel and re-book?

A refund will take up to 28 days so given that your SET(O) application should be straight forward, I think you would be ok to just turn up and pay the difference at the appointment, just say the system was acting very strange. Remember to take the World Pay proof of payment. Though, the safest option would be to cancel and re-book, your choice.

great, IRL granted. thanks alot for your valued advise and help

they made me pay the full correct price, and promised me a refund on the lower incorrect price i paid originally, stating that it was an exception and would not be possible to have done so after rules change in a few days. so very lucky.

on another note: my uncle fell terminally ill and i flew out to Dallas USA to say goodbye to him, before my BRP card arrived (8 days after being granted in Croydon). So i had the card re-delivered to a friend in London, who has signed for it.

Will it be a problem to return to UK in January without the card, show customs my letter of approval from Croydon and ask him to look it up on his system, or should i request my friend in London to post the BRP card to an address in USA before i depart?

Oh I'm sorry to hear about your loss, glad you could make it to say goodbye. You should get your friend to send the card to you via recorded and express delivery to avoid any issues on return.

great fortune: they issued my IRL (even though i booked the wrong premium appointment type)

bad luck: they made me pay the correct appointment type fee in full again, promising to refund the incorrect appointment fee, but that has not happened!

does anyone know what email address to write to, to request the refund?

Hi dj5am, I'm about to do an ILR application for Ancestry as well, and am self-employed via my own company. Curious if you could let me know what sort of evidence you had to provide to UKBA about your self-employment? PAYE wage slips suffice or did you need more, like a set of company accounts? Also if you had a set of company accounts, did you need to get them prepared by one of the approved accountants (ACA, CFA, etc)? Thanks!

i asked my accountant to write a note saying they had prepared yearly accounts and tax returns for myself personally and my company for however many years. i dont have PAYE wage slips to submit. i took my company accounts just incase but didnt need to show them. all the best
