Citizenship with Civil Recovery

Post by citizen_confused » Wed Oct 02, 2013 8:11 pm

Hi,

I am applying for British Citizenship in few days after spending 5 +1(ILR) as dependent. Few days back, I had unpleasant experience. I was shopping with my few month's old baby, I took some items for purchasing it, but my baby became very cranky. So, I thought of taking her out to feed her. This is where I made mistake. I didn't put the items back. Once I came out, one security guard came and took me to a room and started accusing me for theft. I tried explaining them but initially they were not listening. I was quite frightened and concerned as the baby was crying. After some time, they kind of realized and didn't pursue the matter to police and asked me to pay the fine for staff/secuirty guard's time and I was let go. Few days later, I got the letter from Retails Loss Prevention(RLP) for Civil Recovery. I quickly made the payment to avoid any court proceedings.

I am concerned whether I need to put this in the application form. Please help.

There are few cases like yours. Search "shop lifting".

You should be fine; you don’t have to mention it as it was between you and the shop.

On a separate note theft is when you take something away from some one with intention to deprive him or that thing permanently. In your case you only went outside for your baby, which is a legitimate and understandable reason. To be honest the store should not have charged you anything in regards to their staff time. Its ridiculous.

Thanks all for your views and the link. I read it from the link, it looks like my story. I am also of the view that I should not declare it, but confusion comes if the RLP is associated with the police and the police add it to their records, then it will come up in the search, which will go against me. As the guy in that link mentioned, whether this is considered civil penalty or not. I would like to hear from Amber about how he came up with his decision, not trying to question his reply, but rather trying to understand the rationale behind his decision.

You need not mention that in the form as there will be no police record. It was between u and the retail establishment. End of story.
cheers

Hi guys,

Sorry to bother again, today I was going through the documents for my civil recovery, there I saw the original letter from TK Maxx, which says, they will share the details with the police".

How true is that? If yes, will it come in any of the searches carried out by HO? If it does, will I be in violation of information hiding.

Once again appreciate your help.

They write for the sake of writing. I don't think it will be anywhere on their systems.
