Hello - i am an EEA family member going through divorce process. i am currently receiving child benefit and working full time (40hrs). will i be ok to claim child tax credit without it affecting my future application for ROR or PR. The reason why i am asking is because My employer have a child care voucher scheme, and the calculator shows me that i will be worst off if i use the voucher :?

I believe your ROR is based on your spouse exercising treaty rights, as you have the right to reside you should be able to claim benefits.

Hello Amber, sorry bothering you again. In respect of my previous post as i was not sure about claiming tax credit i have previously given my consent for the voucher even before using the calculator. So after your advise i told them i did not want the salary sacrifice child care voucher anymore. But it was too late as they accountant had already procede with the payment. so i now got a voucher for this month plus the tax credit form to fill. :? What do i do???.
[u][i]Is it ok for me to use the voucher this month and still send the form tomorrow without being accuse of fraud?[/i][/u]Plus i did try to contact the Hrmci help line today but that lady was no help with my exact situation and were just giving me general advise.

Please anyone advise

thanks for your advise D4109125. I did spoke with the HMRC today and the lady was no help, she did not seem to understand my point and kept telling me that it was ok for me to claim both voucher and tax credit. I know i could use both but the thing is i will be worst off doing that, so i have ask my employer to stop the voucher, so i will not be receiving any from next month. Now my concern is that i am about to submit tax credit claim and i have one unused voucher.

Can i use the voucher for this month without prejudice to my tax credit claim?

Anyway it seems that i got to use it this month otherwise i will lose the £243.

Childcare vouchers may affect the amount of tax credits you can get. Once you have received the vouchers I assume your salary will be sacrificed and thus the only way to avoid that would be to undo this, if possible, your employer should know.

Yep that is what i have noticed Amber, it does affect the tax credit amount big time. My employer have agreed to stop paying voucher but cannot undo the one for this month. So i will have to use it. Anyway i will send the tax credit form and see what happen. Thank you
