Help please,PR holder need to apply British Citizensip

Post by orangepillow » Sat Oct 12, 2013 3:11 pm

Hi all,
Hold PR since 2010 (under EU law) and need to apply British citizenship, Reason because my wife non-EU has Residence Card expire 2014, to apply British citizenship for her need to wait 1 year with Permanent Residence Card,
if I apply British Citizenship any plus for her?
if I apply now, what documents I should prepare? is that named naturalisation? and how much it can cost me?
I appreciate any answer.
Thanks

How long has your wife been living in the UK? When did you get married?

If you become British and assuming your country allows dual nationality (not all EEA countries do), it could save her one year. She could apply once she completed 5 years of residence as your wife in the UK.

she can apply PR after April2014, but if it is plus to have my citizenship, I need to apply asap,
Before or after she get PR, apply for me Naturalisation is better not really sure.

Cheap and quick don't go together.

She will obtain PR automatically in April 2014.
If you are BC by then, she can apply for BC when PR status is obtained (April 2014). Otherwise she will need to wait 1 year after PR (April 2015). So saving 1 year would cost about £1000 (for you to become British).

Correct. She doesn't need to apply for PR first as this is obtained automatically after 5 years. There is a section in the naturslisation form for such cases of family members of EEA nationals.

You will need to pass the LIUK test in any case regardless when you apply and meet the English requirement if apply after the 28/10.

You can also use a solicitor to certify the copies and send by post to the HO.

Do this test. Costs £ 125 a shot. Easy peasy.

Orangepillow

I am from Poland and I am too married to a non-eea citizen. It looks to me that you did not quite understand Jambo even though he explained it clearly.

Because you got married in April 2009 to your non eea spouse, she will get automatic Permanent Residence after 5 years (in April 2014) without the need to apply for Permanent Residence (EEA 4) as this just optional and not a must. Permanent Residence is the equivalent to ILR and this is the requirement she needs to meet for citizenship.

If you become British now, your wife will still only be able to apply for naturalisation as a BC after April 2014 and never before. Remember the law says that spouses of BC should have ILR=Permanent Residence before applying for citizenship and she will only achieve this in April 2014.

You mention the 3 year rule for spouses of BC. Forget about it! it does not apply to you because when you too got married in 2009 you were not British and still you are not. You are still an EEA national. Do you understand now where I am coming from?

I naturalised as a BC 2 months ago and my non eea wife and child have sent their AN and MN1 forms for naturalisation. She too had a Residence card that expired even 2 weeks before she sent her AN application but it does not matter. She got automatic Permanent Residence in October 2012 after 5 years in UK as the wife of an EEA. We got married in September 2007. She did not choose to apply for Permanent Residence (EEA 4) as this is not compulsory and it takes bloody ages.
She could have applied for BC after October 2012 but we decided to wait for me to become British first to make things easier for her.

Good luck and all the best.
