Absence days for spouse's naturalisation - PLS Urgent

Hi,

Please help me to understand if the absence allowed is 270 days or 300 days. The following links confuses me. One says 270 the other says 300 for 3 years residence category. Please help me as my wife is outside UK for 290 days within the last three years.

Is your wife applying as the spouse of a British Citizen??

If so, then the rules are :

Residential requirements
In order to demonstrate the residential requirements for naturalisation you need to:
-have been resident in the United Kingdom for at least three years (this is known as the residential qualifying period); and
-have been present in the United Kingdom three years before the date of your application; and
-have not spent more than 270 days outside the United Kingdom during the three-year period; and
-have not spent more than 90 days outside the United Kingdom in the last 12 months of the three-year period; and
-have not been in breach of the immigration rules at any stage during the three-year period

If you are BC and she applies as spouse of BC, she should be fine with the absences as stated above and if she meets all the standard requirements.

I myself applied as the spouse of a BC with 277 and it was totaly fine. I also didn't mark the section on the form asking for discretion based on the guidance I received from this forum. So I beleive your wife should be fine provided she meets all other requirenments.

Make sure u dont counts the day ur wife left uk and the day she came back on each absence as alot ppl do count.its a very common mistake.

I have further doubt while filling my wife's application. I have moved to new property when my wife went to india for maternity.

She was away from 27th of Aug 2011 to 1st April 2012. I moved to the new property on 24th November 2011. I was paying Council tax and Utility bill on her name during these periods.

When filling 1.16 in page 3 and page 4, Should I have to mention the date that she moved into this address as 24th November 2011 or 01st April 2012?

If I have to mention 1st of April 2012 in 1.16 in Page 3, Should I have to mention her india address from 27th of Aug 2011 to 1st April 2012 in 1.17 in page number 4?

She is here for 3 years 10 months Should I have to mention her India address for rest of the 1 year 2 months?

Or should I only have to mention her UK addresses?

Amber, I applied for naturalisation asking question very late though

I was in India on business trip but had to live in indian address for that period

I mentioned that in Form AN, NCS said nothing about it

Do you think that will be okay?
