advice needed please

First of all, sorry that the story is so long but we could do with some advice. My son went over to America and married his wife. He went as a tourist and overstayed by a year without even applying for a visa. They had a child together whilst in the us. They have all now come over to the uk and live together in my sons flat. His wife came here as a visitor and has overstayed the 6 months she was allowed. Now her mother and her other son have joined them in the uk but when they came through customs questions were asked. They have all been told that they need to take there passports to Manchester airport where they will sort the appropriate visas out for them. I was wondering if they will actually help with their visas or is there a chance they will be deported and told to apply from within the U.S. Any advice will be much appreciated. Thanks

Pretty sure it's deportation, such wanton abuse of the visit visa process deserves it.

The wife and son and maybe stepson (if under 18) will be ok eventually but the mother can pack her bags now I'm afraid.

Then they'll have to either consider the EEA route or apply on the grounds of family life.

From the informaton provided, the application won't fit on any of family route strands.

EEA route? If someone is unemployed and on benefits in UK, then what chances they have to find work in another eu country?

Do not want to dishearten anyone. I am just being realistic.

If the children are British then exception 1 may apply.

As far as UKBA is concerned, applicant has the option to move to USA. We are talking about the possibiltiy of returning to USA, and not Somalia. If this application succeeds, then I would say all immigration controls should be totally removed.

I think you should read the guidance, particularly sections 7 & 11 before making statements based on your own opinion.

My son is a U.K citizen. He went to America and married his wife and they had a daughter together. My son, his wife and their daughter came to the U.K in February. They only got a visitor stamp on their passport which obviously they overstayed. A few weeks ago, my sons American mother in law also came over with my sons stepson. They were stopped at immigration and told they had to return for an interview. They went back and were told that all 4 us citizens were allowed to leave but they had been denied access to the U.K and would be deported shortly. The reason being that they do not meet financial requirements and that they were here illegally. The problem is that when they are returned to America they will be homeless with nothing
. My son cannot afford to go with them and worries that he will never see his wife and daughter again especially as they will be on the streets. Is there anything we can do to. Any help is really appreciated. Thank you
