ILR for 4 years child from Outside the UK

Post by sss123sss » Wed Oct 16, 2013 10:15 pm

My wife and I have settlement visa (ILR) and want to apply ILR for my 4 years child who is in outside the UK.

What is the process for applying ILR for 4 years child who is in outside the UK?

The application itself is quite straightforward but the outcome will be decided based on who is and has been solely responsible for the taking care of the child now in the past (takes the important decisions about the child's upbringing) and whether that person is or is not the sponsoring parent in the UK, or another adult (grandparent?) in the child's home country. Can you confirm that you and your partner would match that profile?

1. Child was born outside the UK
2. We are the sole resposibility of the child eventhough child is leaving with grand parents.

As we are settled parents, 1) can we apply ILR in child category? 2) Do we need to fill VAF4 and VAF4 Appendix-1 forms? 3) My wife received ILR under PBS dependent category. Can she be the sponsor?

Yes it's appendix 1, either can be the primary sponsor.

Thank you very much for the responses.

Could you please provide me the documents checklist that has to be submitted along with the application?

There isn't one, rather adequate maintenance and accommodation.

In VAF4 form, they are asking sponsors "Normal Country of Residence". Should it be India or UK?
