help with FLR

Post by watercressman » Tue Oct 22, 2013 10:50 pm

Basically my wife is from Hong Kong and we was granted a spouse visa for 2.5 years till 2015 based on the family route, but we originally went for the FLR 5 year route and then ILR but was refused because we did not have the English test (even thou she went to a ESOL school but they were just incompetent) but they still granted us the Spouse visa because of the family route (having a baby) in the letter that they sent they said you will have to wait 10 years to apply for ILR is this right????? my wife has now passed the english test with certificates to prove it, does this make any difference to the time? because does this mean i need to apply a further 3 more times on FLR 2.5 years 3 times so 2022 is the earliest i can apply for ILR please help im confused and im sorry if the wording is bad

This should be in the family members section.

When was your spouse granted leave?

Yes the family life route to settlement is 10 years.

If she meets the requirements for FLR(M) now, she may switch to that category if she meets the A1 English requirement and financial requirement.
