The reason for refusal: Team application, no joint account as bank has disagreed to provide a joint account as both team members were closer to the visa expiry date. We provided a declaration from a legal authority. UKBA misinterpreted as third party and refused as information in the document was insufficient.

Outcome of the hearing: Recommendation to the UKBA by the judge to review the application.

Question: How long does it take to get an update from the court or UKBA after the hearing. Can anyone reply if you have been to the hearing.

normal procedure is 4weeks however it may take longer as well.

I just had a look at the following link and it says 10 working days under the "Tribunal's Decision". So do they take more than what they state :?

The link you have pasted does not mention your situation. You case is referred back to UKBA as per my understanding and i dont think you will get any letter from tribunal now other than what you have received.
Your case would be considered again by UKBA with your supporting arguments which you prepared for hearing purpose. This way UKBA will get a clear picture what happened actually.

So I guess, just assume your application submitted to HO just like before refusal. Only extra stuff you have submitted now is your justification of not having joint account.

dear sir,

appeals when heard have 3 different implications,
appeal allowed that means you meet or met all the relevant immigration rules, in this event you will get you BRP shortly if respondent does not chase it for higher court.
appeal allowed (limited extend where judge thinks appropriate) it goes back to border agency for reconsideration of the decision,it means another refusal(less likely),application being approved (more likely), border agency will chase it for higher court(very rare)
appeal dismissed, it means you may chase it for higher court

Thank you Top! They allowed appeal and send to HO to reconsider. It was informed to us in the court itself.

My worry is, is there any documentation/update from the courts/HO will be send to me shortly?, because I do work in another company 2 days on contract basis from our company. They need a documentation, But before going for an Employee Check, I am wondering will I be able to get a document to submit to my employer which I may receive from court or HO.

your status is now reinstated as it was at the time application since appeal decision however it was different with border agency as they refused your application which has now been resolved.

consider yourself and status is as it was at the time of application and application is being processed of which decision is yet to be made by border agency is how you put your activities in place.

you may be asked for more documents proof of funds etc(less likely). and/or provided with a BRP (more likely) or another refusal(less likely) as far your question any acknowledge from border agency as appeal fell in your favor you should know your application is now in process in such a situation as this any of above mentioned things will happen sorry there is not any time frame for that..

Thank you so much Top. Its very clear...will hope for most likely options and wait. We are running the business genuinely so we are prepared with less likely too. Lets see how the outcome from HO. Thanks a lot!

Hi Lilly_j - Please can you inform whether u had refusal due to no access to funds as funds were in each of your personal accounts. If yes, please can you inform me about the barrister who represented you for your case. I will be very grateful if you can provide me with this information.
