UK Tier 2 validity for ILR

Hi All,

Please could you advise if I am eligible to apply for ILR though I am currently holding Tier 2 ICT Long term but I have got my 1st Visa in 2007 as Work permit and same has been extended until now .

Details are as follows:

- Entered to UK in June 2007 on Sponsored work permit for 2 years until Dec 2008
- Got the same visa extended for 2 years until Dec 2010
- Extended the visa from WP to Tier 2 ICT Established staff until Oct-2013
- Recently extended the visa and now got Tier 2 ICT Long term for another 2 years until Oct 2015.

Please advise with current Visa type and history of visa type changes, Am I eligible to apply for ILR?

I came to UK for the first time in June 2007 and then had few visits to india (to and fro) until now with same visa though it was extended 3 times . Current type of visa is Tier 2 ICT Logn term with same employer

I came to know that with recent changes in UKBA rules, one can stay outside country for 6 months for a year. Considering this,

1. When can I apply for apply ILR considering below years?

1. Year 1 19-Apr-14 20-Apr-13 ----> No gaps
2 Year 2 19-Apr-13 20-Apr-12 ----->176 days absence
3 Year 3 19-Apr-12 20-Apr-11 ------> 33 days absence
4 Year 4 19-Apr-11 20-Apr-10 -----> 13 days absence
5 Year 5 19-Apr-10 20-Apr-09 -----> 163 days absence
6 Year 6 19-Apr-09 20-Apr-08 -----> No gaps
7 Year 7 19-Apr-08 09-Jun-07 -----> 4 days absence


2. Will it be ok if i apply for ILR immediately?

3. I am considering year1 from April 2014 as if I consider any other date before April from now then i am getting more than 180 days gap in an year. Though I think with current rule I was eligible to apply for ILR in the beginning of 2013. Please suggest if I have to wait until then?

4. Do i need to get any letters from employer for these absences?

Any help in this regard will be highly appreciated.

I got the answer to my first query that i am eligible to apply for ILR as i was on Old WP and got that extended until now with ICT Long term visa.

I still didn't find answer to my query on when i am eligible to apply for ILR as i think i was eligible to apply ILR 10 months back but unfortunately was not aware of this change in rule.

Your response on query posted on this would be a great help.
