Good character requirement, please help ? ? ?

Post by Way2go » Mon Oct 28, 2013 10:14 pm

I have been issued with simple caution for public disorder by police, please advise if and when I would now be able to apply for nationality as I was about to apply it next month. Will it effect my application and do I have to wait three years before applying now. Thanks

I'm afraid you will have to wait. See British Citizenship – Good Character Requirement FAQs

Dear All,

Please help me. I'm applying for naturalization from FORM AN - Under Section 3.8 "Do you have any civil judgement against you or any civil penalty under the UK Immigration Act" What should I select YES or NO for below query,

During my previous application for ILR, got rejected based on overstay, Home Office rejected case with Apple Allowed, then WON the case after one and half year !! got ILR.

Question: Do I need to specify under section 3.8 - YES or NO ??

Thanks in Advance

Dear Amber,

Please can you help me in replying below,

The FORM AN says - SECTION 3.2 - An Employee or A Business Partner or Self-Employed or A Director

I have my own Limited Company and am Director of it.

Question: - Do I need to click Self-employed or Director ? or Both ? If Look at the bottom of FORM AN Doc page no-18(last page), it says,

SECTION 7 Evidence of tax for self employed applicants only
The most recent HMRC Self Assessment Statement of Accounts !

As a Director what documents should I submit along with Application, I have paid tax up to now. And from HMRC received confirmation by email about tax returns.

Thanks in Advance

I'm in the same situation.
You need to tick "director" and you dont need to send self assesment statement of accounts as you're not self employed even if you're the only director and shareholder, you're an employee of your own company (Confirmed with HMRC).

And you need to write your company's PAYE tax reference number to the form.

Amber,

Please can you clarify one thing while filling on FORM AN "SECTION 5: Referees and Identity" the photograph need to be signed with Date of Birth back of it and glued and pasted into the space aside.

Question is - How Referees and Home Office can check the photograph whether signed or not once GLUED or PASTED !!? OR

May be we need to attach two photos ?

Please can you clarify.

Thanks in Advance

No, you just follow the guidance, use a paper clip to attach the photo rather than glue. Just make sure you write full name and DOB on back.

Dear Amber,

From SECTION 3.8 -" Do you have any civil judgments against you or any civil penalty under the UK Immigration Acts ? "

Question: I had Traffic offence in the year 2008 and paid penalty of 400 pounds and given 8 penalty points. During my last application for ILR I got new DVLA Counterpart with no points on it. In that situation do I need to select YES or NO ?

Thanks in Advance

Were the points and fine issued at or via the Court?

Then it's a criminal conviction (rather than civil wrong) and should be declared as such.

Amber,

I didn't go to court but by post they ask me to pay penalty of 400 + 8 points. I have cleaned all the payment and even penalty points too!
Now I got new Counterpart from DVLA which shows no penalty points on it. It happened in the year 2008, and after 4 years the points get clears automatically.

Question : If I declare this as criminal offence will my case get rejected ? If so after how many years will eligible for passport ?

Thanks,
KLV

If you plead guilty by post it's still a conviction I'm afraid.

Dear All,

Last Week I went to NCS for submitting application FORM AN, the officer rejected to take my application for below reasons:

1. For last five years Tax returns to be submitted, but for year 2009/10 tax returns are missing like I was on holiday and my mother passed away and varies reasons I was out of UK and more over I formed the company in the year Aug 2010. I explained same thing to
him as I had no job, he is not accepting and told me get proofs of tax returns for this year and given me one month time for re submission of application. Please guide me what I have to do now.

Thanks in Advance
