FLR(O) refused, Q on appeal.

Post by mandeelui » Wed Oct 30, 2013 10:11 pm

Hello all, I applied for an FLR(O) but refused because although I'm under 25 I haven't been here over half my life

(I was 11years and 10 months old when I came to the UK and had been here for 11 years when I applied, I originally applied on the 10 year reason but I have left the UK for too many times)

So now I would like to appeal (Article 8 ECHR) and looking for advice, has anyone been through similar situations please? Also, should I get a lawyer/solicitor? I would really like to stay in the UK, this is so stressful.

Any help appreciated and thank you in advance!

I assume you were given the right to appeal? If you appeal, then when the tribunal convenes, it can consider the fact that you have satisfied the requirements of 276ADE(v) (assuming you will have).

Hi, I'm 10months from satisfying "half my lifetime" and so far the process has been nothing but speedy. I was told it would take 2 months tops to the appeal. By then I will still need 8 more months to satisfy that clause.

Thank you for your speedy reply, by the way.

Who told you two months? I'd say considerably longer than that based on others.

A lawyer I spoke with, he said because the HO is minimising the number of cases that could appeal, so everything's going through quicker now. But he is also the same lawyer that says my appeal could cost up to 6k.

Do appeals really cost 5-6k?

It depends how much you do and who you use I imagine.
