Temporary contract ending and still waiting on visa decision

Post by LonelyWife2 » Sat Nov 09, 2013 12:53 pm

Hi everyone,

My husband had his interview at the embassy on the 30th of September. A few weeks later he received an email saying that the visa is being processed and we should get an answer in 35-40 working days, putting a response time for the end of November early December.

My contract expires on the 9th of December and I'm worried that I should try and stay with the company longer. I ideally want to go into self employment, and will earn more money but it might make things complicated down the line. I could stay on til march at my current rate of pay (16,000 pounds, I have the savings to back it up) or apply for my bosses job and end up in a job that I don't really want, even though it pays well enough.

So my question is is my application safe because I was employed at the point of application or should I look to keep going with my current employer, even though it is financially and personally not what I want to do?

I think my application should be fine, plenty of evidence that we have a genuine relationship, financial requirement met etc. The only thing that worries me is that there was one bank statement missing and I got a statement printed out in the branch with a letter as attached, all official and from the bank just not on letter headed paper, as they don't have that in the branch.

Thanks for your time,

Rachel

Given how complicated it is using self employment as a proof of income for this, i would advise you remain in the job you have currently or even go for that promotion even if it's until your husband arrives.

I moved from being a temp at one place to a permanent job at another reluctantly as I'm still waiting for the outcome of my husband's application but decided worst case scenario I can submit the details of my new employer if they query anything and I have still earned more than the required amount 12 months prior to starting the new job. It is a slight gamble, but I didn't want to risk being without a job at all.

Thanks hopeful, good luck with your situation.

But in terms of the application, providing nothing goes wrong, will they look at the application at the date of the application or will they look at the situation at the time of the decision?

My understanding is that they should consider things at the time of application, however if they decide to checks on finance/employment/etc then they would know about the changes. In an ideal world you could forward on new job info but my worry is currently that they could simply refuse because they were unable to verify job details when doing the checks.
