Equivalent of EEA family permit in Spain

Equivalent of EEA family permit in Spain

Hi, I wonder if someone can help me.
I am Russian citizen and I have British citizenship as well. My husband is Russian citizen. I live in the UK and want to take my Russian husband to live in the UK. however, the only way we can do this (because I don`t have the finances for a spouse visa) is to go to Spain (because we have a friend there) and exercise my treaty rights by working for 6 months and then apply for the EEA family permit to enter the UK using the Surinder Singh route.

My question is, how can we get to Spain, both travelling from Russia at the same time? Is there an equivalent of a EEA family permit for Spain? My understanding is a Schengen visa would expire after 90 days and my husband would have to leave.

There is no defined/fixed length of time for British/EEA national to exercise its treaty rights in another member state under Surinder singh route. Check this diagram

A free Schengen visa (as a family member of EEA national) is the equivalent. It might expire in 90 days but you don't need to leave the country as long as the EEA national is exercising treaty rights. In some member states you are required to register if staying for more than 90 days.

Thank you. However, I was talking with Spanish embassy in Russia today, they told to me, that my husband need a National visa for entry and work more than 90 days. And he needs to have a contract from employer. Could you provide , please, a relative information which you posted.

They are wrong. National law doesn't apply to you. EU Directive does.

Thank you for the provided information. Another question is how my husband can apply for EU Family Permit in Spain. Could you provide, please, the web link?
