UK born child s1(3) and parent ILR

Post by kkrish2013 » Sun Nov 17, 2013 9:54 pm

Hi
I am applying for ilr in apr '14.my child-5 yrs was born in uk and was informed that child can apply for naturalisation directly and not required to apply with my application.

my questions:
1.what happens if I dont get my ilr result before the expiry of my childs visa.
2.Can I apply for ilr and send my childs s visa for naturalisation directly at the same time.
3.What happens in case my application is refused.will that affect my childs naturalisation.
4.What docs required for naturalisation. As I will be sending my passport to home office, does the childs naturalisation require my passport?

Awaiting all your valuable comments.

Advance thanks.

1. If child has previously applied for leave that has expired, then child will be an overstayer. However, being an overstayer will not effect UK-born child's entitlement to British citizenship after a parent is granted ILR.

2. Best not to apply at the same time.

3. UK-born Child's entitlement to British citizenship is subject to parent being subsequently granted ILR or child's 10 years residence in the UK.

4. See form MN1 for details.

Thanks for your response.

I am aware that my uk born child can apply for citizenship once I get my ilr.

my question is what happens to the time she lives in uk, till my ilr decision is made, if i don't include her in my application and her current visa expires before the decision is made..

Awaiting your reply.

As said, the child will not have a valid visa and will become overstayer. This should not affect the registration application later. It's not as if the HO would knock on your door to deport the child. However the child will not be able to re-enter the UK if travelled abroad without a valid visa.
