English language requirement confusion

Post by vishme6 » Wed Mar 12, 2014 11:54 am

Hi,

I had a query on the English language requirement for me and my dependent wife. I understand this question has been asked several times earlier on this forum. But when I tried to access the forum topics related to this, I got bit confused and lost in too many responses - some were contradicting to the earlier ones that I read.

I entered UK with Tier 1 General Migrant VISA issued on 01Apr2009. I am planning to apply for ILR this May and came across this section in the ILR form:
"From 28 October 2013, to qualify for indefinite leave to remain, all applicants aged 18-64 must meet a revised Knowledge of Language and Life in the UK requirement."

On referring the guidance notes I noticed, this part of the requirement can be met if the person:
 has an academic qualification (not a professional or vocational qualification), and
 provides appropriate evidence that the qualification was taught or researched in English.
The qualification must be deemed by UK National Academic Recognition Information Centre (NARIC) to meet the recognised standard of a Bachelor’s or Master’s degree or PhD in the UK.

I have done my Bachelor of Engineering from Mumbai University (4 years) and my wife has done her Bachelor of Homeopathic Medicine and Surgery (5 years). I was thinking of providing these docs for both of us:
- University Degree Certificate in English
- Letter from College confirming degree was taught in English

Do we both have to provide a comparison letter from UK NARIC even when we have Bachelors degree? I had already proved my English language requirements when I first applied for Tier 1 VISA. Do I still have to do it again?

As per the statement below, when I enter my Bachelor's degree in PBS calculator, I noticed that I am awarded zero points for that!
A printout from the points-based calculator, confirming the equivalent level of the degree, and that it was taught or researched in English. The printout must show the degree has been awarded at least 20 points, and an additional 10 points for English
language.

Am I doing anything wrong while entering details in PBS calculator? I have attached the points awarded for degree in PBS.

Any help will be appreciated.

I think I got the mistake. I was wrongly entering my date of application in the PBS calculator.

I get 30 points for my Bachelors degree. What do I do for my wife? What should I put her date of application in the PBS calculator. She applied as dependent in July 2009. Will she get 30 points as well for her Bachelor's degree in Medicine/Surgery?

Please respond to my other questions if possible.

Hi,

If you are not getting 10 points for English from PBS calculator then its better to get NARIC letter for British equivalency. Better safe than sorry.

Hi,

I did get 30 points for my Degree and 10 points for Eng. language.

I am confused about my wife now. Is she applicable to same rules as me even though she came few months later when Bachelors degree was no longer recognized?

For your wife, start entering your details to start with in the PBS calculator. When you reach the degree part, enter your wife's qualification and proceed. If the points calculator shows points for degree and English then she doesn't need NARIC letter. Just the original certificate and relevant pages of points calculator i.e degree and English part.

As your wife only has to show English language qualification, rest of the details on PBS caclulator doesn't matter as she doesn't require points per se to get ILR. But to reach to the degree page one has to enter relevant details hence put your details.

I did the same for my wife and have recently got ILR.

Hi Vagbond,

Thanks for your response.

To use the PBS calculator for my wife (Tier 1 dependent) applying ILR, she has to select the following:
1. Select the Tier for which you are applying. - Tier 1 High value migrants
2. Select the category of Tier 1 for which you are applying - Tier 1 general
3.Enter the date of your first successful Tier 1 application. - 18Mar2009 (THIS IS MY DATE OF TIER 1 APPLICATION. MY WIFE HAD MADE AN APPLICATION IN AUG 2009.)
4. Do you want to claim points for your age?
Yes or No? If yes, do I have to put my age at first application?
5. Please check the attachment to see the selections are ok?
6. How would you like to claim points for English language skills?
Should I select "I have a qualification comparable to a UK Bachelor degree that was taught in English"
7. Should I be filling the rest of the sections in the PBS calculator?

Do you mind sending me the PBS calculator pages you used for your wife?
