Hi everyone,
Hope someone could help us with the right information. The Home Office just answered for our enquire that we can find all information on the www.gov.uk site. Well, I couldn`t find it.
I am Hungarian nationality, I am exercising treaty rights in the United Kingdom since February 2008. Last month I applied for a Permanent Residence. The application has been refused because I did not register with the Immigration and Worker Registration Scheme. (I didn`t know I had to and none of my employer asked)
As I have read, from 2011 no longer necessary the registration I believe I can apply again at 2016?
The reason that I applied for the Permanent Residence that I settled in the United Kingdom with my husband. My husband is Algerian and he has a 5 years permanent residence card. Our baby born 16th of May 2014. As I know to apply a British passport for the baby one of the parent has to prove that exercising treaty rights in the UK for a continuous period over 5 years. I have all evidence such as P60s, P45s, payslips, tenancy agreements. Can I still apply British passport for my child even though I don`t have the WRS certificate?
We are planning to visit my husband`s family in Algeria soon. If we apply an Algerian passport for the baby how we can bring back him in the country? Can we apply residence card for him? How we can do that? To apply a Hungarian passport for him is take minimum 8 months.

Unfortunately the period when you didn't have the required WRS won't count, unless you were exercising treaty rights such as self employed or a student with CSI.

The child will be entitled to register as British when you finally attain PR.

Yes, this was what I`m afraid of :( Thanks for your answer.

So how we can manage to travel? The baby need a residence permit if we want to take him to Algeria for family visit. First we need Algerian passport and then ask residence permit? If yes which form we have to fill? EEA2?
Or we can put residence permit of baby to my husband`s passport and after apply for Algerian passport?
Or more simple if I ask Hungarian passport for the baby? This is what I really want avoid. The Hungarian embassy is incredibly slow and bureaucratic.

It might be easier if you just get a Hungarian passport for your baby.
