Restriction for UK overstayer

Post by sariq » Sat Sep 05, 2015 6:51 am

Hi guys
I just signed up to this forum and want your help
Immigration History
1.Travelled to UK in 2011 at tier 4 general student
College's Licence Revoked in 9 month
2. Returned to home country with overstay of 171 days beyond my visa expiry.
I returned voluntary without out contacting to home office
3. Managed to stamped my passport in back date on arrival.
one month before visa expiry
4. It is not evident from passport that I have overstayed.

5.Apply for tier 4 visa in 2012 but refused under paragraph 245ZV (k).
ECO did't mention that I have had any overstay.

Now I Want to apply under EEA Family Permit by getting marry to EU national.( She would travel to UK 1st time).
Question

1. Would the UKBA know that I have had overstay previously?
If yes, How it could effect my potential application ?

2. Should I ask my girl to travel to UK now and become a qualified resident by staying 3 month and do some paper work I.e. wages slip, bank statements etc.?
OR
Ask her to come to my country and then both travels together to the UK, if they would grant me entry clearance, an allowed route under EEA Family permit I understand.

Where are you intending to marry?
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
