Tier 4 application after 3C leave

Hi guys,

I am on 3c leave and i got unconditional offer in masters.
My previous visa was PSW and after that I got refused on tier 1 enterperenuer visa
I would like to ask when I can apply for tier 4 visa, and if I got a visa in November what would be my status after november because course starts in January.
Do I need to leave country?
My hearing date is on 30 October
I am thinking apply in premium services

You will need to withdraw your appeal before you can apply for any other visa.

No idea where they are quoting 3 months from, and would be interested to know. The immigration rules say that applying for Tier 4 leave as an overstayer will result in a refusal, unless the overstay is 28 days or less.

However, you also need to check with your Tier 4 sponsor what is their approach to applications by overstayers. They certainly cannot enrol someone who applied as an overstayer, but who has not yet had the outcome of their Tier 4 application.
