I Need some Clarifications Immigration Law 320 (7A) Refusal

Post by Hiantaw » Sat Apr 30, 2016 9:24 am

Hello All...

I recently applied for Tier 2 Work Migrant Visa for 3 years..

It just so happen that I honestly forgot to indicate my old passport and my previous Tourist Visa application last 2007, a friend applied for this Visit Visa before which was sadly declined. That was like 9 years ago.

Now when the result came, it was indicated about this Refusal of Entry Clearance under Paragraph 320 (7A).

Since I panicked, I searched for this incident and found it on my old inbox way back 2007. So I informed my employeer and they suggested to reapply and make a new application. Which I did...

This time I already indicated this refusal last 2007 and now which is the recent one. But I already totally forgot my old passport details and which is already lost now. Is this okay? How are my chances this time? What document should I provide to prove this honest mistake? Should I make a letter? Show them my previous email? Thats my only proof...

Your feedbacks would be of great help.

What has your friend's visit refusal to do with you?

A refusal under 320(7A) will result in automatic refusals under 320(7B) for 10 years, unless exempted under A320.

Tier 2 is not a category for the exemption.

Your only chance is to convince them that any false representation was due to an innocent mistake.

I really don't know all about this? Do i need a solicitor for my case? Or a barrister? I need to lift this 10 year ban and rectify this "honest mistake". If you have suggestions who I should approach please do advise. I am perfectly clueless.

Try Approaching the Entry Clearance Officer or Entry Clearence Manager at the British Embassy or High Commission first.
