"Example situation:

Applied for 1 year visit visa as a visa national outside the UK on 01/01/2008
Granted entry clearance as a visitor, multi entry for 1 year 21/02/2008 - 21/02/2009 on 21/02/2008
Entered the UK on 25/02/2008
Left the Uk on 26/05/2008
Re entered the Uk on 27/07/2008
Left the Uk on 28/08/2008
Applied for entry clearance as a student on 29/10/2008, granted on 01/01/2009 while visit visa still valid
Entered the UK on student visa on 03/01/2009
Ever since been on student visa and applied for ILR on 27/02/2018 long residence"

Has their continuous residence been intact from 25/02/2008 to 27/02/2018 through out the 10 years? or has it been broken? what's your opinion guys?

Hi guys help
Just been granted FLR FP 10 years.expires in 2020
But march next year would make it 10 years of legal residence in the uk for me.
So my question is can i apply for ILR 10 year althought i still have a valid visa running with plenty of time left on it? Or will i have to wait till 2020 to apply for ILR ?

Hi All

I am about to apply for SET(LR) - next month, i would like to know if i need to get an immigration health surcharge reference number? I read somewhere that even though you are not required to pay for IHS, you need to get a reference number, is this true for SET (LR)? Thanks very much!

I have researched this and the best answer I have come across for this is that they only calculate the absences for the last 10 years as the requirement is you have lived continuously in the UK for the last 10 years. Anything before that shouldn't count.

In words applying for ILR LR would be a massive risk althought i would definitely have 10 years legal residence..what would the reasons for refusal be if i can prove 10 years legal residence?trying to assess the risks.

Yes i think i do vinny.
-i landed in the uk in september 2009 with a 3 years
Tiers 4 general visa.
-got married and switched to FLR M 2.5 years in 2012(july)
-renewed my visa in 2015 this time FLR FP, 2.5 years
-last week got another 2.5 years FLR FP that expires in 2020.
No criminal record,never overstayed,married father of 3,all british citizens,wife included.
I believe i should qualify for SET LR in september 2019? But my current visa expires in october 2020 so i heard if i apply in sept 2019 for SET LR i could be refused with no right of appeal

Guys,

Need some advice. I have applied for ILR via postal application on a 10 year route.

Date of application : 15-Feb-2018
Biometrics letter received : 13-Mar-2018

I have 15 working days to apply and plan to get my Bio metrics done on 29th March.

Can you please advice me how long will it take from there for decision? I am aware that it can take up to 6 months. But is 6 months calculated after giving biometrics or date of application?

Also, what is current turn around time from HO?

in a long residence case where i came in the uk on 28 may 2008 till 31st October 2009, on student visa,extended it to 31 December 2011,
31 dec 2011 i made further leave to remain application which was refused by 31st oct 2012 leaving me with two options either to appeal or leave the country and make an application from home country pakistan,i did not appeal but left uk on 25th Nov 2012 (within 28 days) to Pakistan due to sudden death of my uncle and my own medical emergency .

applied t4 student visa on 3rd January 2013 and came back to uk on 3rd feb 2013.
can i apply on 10 year long residency route ?is it broken or what ?
can you please assist me i am currently on 2nd term of (2.5) spouse visa expiring may 2019 making me eligible for ILR via SET(M).

what do you suggest if i apply now on long residence route and if its refused will i be able to keep my spouse visa ,do you think a discretion can be exercised by Case worker?
can you pls advise on this matter

hello everyone,

I am a new member in this forum
just need a quick advice on my husbands & my application.

we applied for an ILR 1st time in may 2016 on tier 1 route and varied our application in sep 2017 on 10yrs long resdence for my husband and mine for a dependant because i havent completed my 10yrs yet.

since we varied our application my husband received an email on 18th oct 2017saying that it is being considered and then we recieved his biometric letter, and i recieved letter on my name on 13 oct 2017 saying that ,

thank you for your application for permission to stay in the UK
although we would normally decide your application within eight weeks from the date it was submitted, unfortunately this is not going to be possible in your case.
this is because you have varied the grounds of your application, and we must now begin considering it afresh.

i recieved 2nd letter on 23rd march 2018 saying that,

Thank you for your application for leave to remain in the uk
we wrote to you on 11th oct 2017 to inform you that we would not be able decide your application within eight weeks from the date it was submitted,
we also advised that we expected to make a decision on your application once your spouse's application for indefinite leave to remain in the uk has been decided.
this is because we now require further information or evidence, see below for the details
to help me consider the matter, please send me the following documents.
(and the asked me income proof of both of us from nov 2015 to apr 2016.)
our aim is to make a decision on your case promptly.

so my question is
does it mean that they have already approved my huabands ILR thats why they are now processing my application? or
its still long way to go for ILR?

Hello Everyone,

Just wanted to let you all know that I have been granted ILR today. I have been a silent reader like a lot of people so I thought this should help/give hope to quite a few people.

I initially applied in Arpril 2016 on a Tier 1 General route but then changed my route to ILR LR just after a year in April 2017. I was since sent a self employment questionnaire to be filled which I sent back with all the requested documents.

I had a tax amendment in one the years which was corrected before I applied in 2016. Thank you all for the support specially the admins. It is much appreciated.
