Just been granted FLR FP 10 years.expires in 2020
But march next year would make it 10 years of legal residence in the uk for me.
So my question is can i apply for ILR 10 year althought i still have a valid visa running with plenty of time left on it? Or will i have to wait till 2020 to apply for ILR ?
I have been granted FLR FP as a partner. I have researched this and the best answer I have come across for this is that they only calculate the absences for the last 10 years as the requirement is you have lived continuously in the UK for the last 10 years. Sorry that was my reply for someone else. But I did find an answer to your question, what I found is it is possible to apply for ILR long residence when you complete 10 years legally. But if you have a valid visa running during the application and your application is refused, you won't get an appeal right. I guess it's taking a risk. In words applying for ILR LR would be a massive risk althought i would definitely have 10 years legal residence..what would the reasons for refusal be if i can prove 10 years legal residence?trying to assess the risks.Sorry that was my reply for someone else. My greatings vinny sorry to jump in like that my top man. i would like you to enlighten me on something that is confusing me a little bit..if one has hit the 10 legal stay landmark is it possible to apply for SET LR immediately,when one has a valid visa running(FLR FR PARTNER) with one year left on it?

question i am concerned about is below .
in a long residence case where i came in the uk on 28 may 2008 till 31st October 2009, on student visa,extended it to 31 December 2011,
31 dec 2011 i made further leave to remain application which was refused by 31st oct 2012 leaving me with two options either to appeal or leave the country and make an application from home country pakistan,i did not appeal but left uk on 25th Nov 2012 (within 28 days) to Pakistan due to sudden death of my uncle and my own medical emergency .
applied t4 student visa on 3rd January 2013 and came back to uk on 3rd feb 2013.
can i apply on 10 year long residency route ?is it broken or what ?
can you please assist me i am currently on 2nd term of (2.5) spouse visa expiring may 2019 making me eligible for ILR via SET(M).
what do you suggest if i apply now on long residence route and if its refused will i be able to keep my spouse visa ,do you think a discretion can be exercised by Case worker?
can you pls advise on this matter
