I am living in the UK last 17 years,came in 2001, back in 2016 my application was 15 days late submitted for FLR due HO was holding my passport due to working allegation as student even actually I was working less than 20 hours, It all happened due to family friend complaint,Before moving direction issue I have submitted JR after two year HO took case back and gave me visa, my previous leave was expired during the case and new visa was issued in 2007, I have submitted ILR application in 2012, HO gave me FLR FP leave instead of ILR before this my solicitor submitted my family application on FLR FP which HO refused before my application decision. My family got leave to remain and then HO attached me with them.
Now my wife got ILR, my kids got British passport but I am on FLR FP. I have applied ILR in 2017 but few questions were asked because my initial application back in 2011 was Tier 1, my accountant not correctly submitted return divided profit in two accounting period, I have withdraw my case applied amendment of my initial application tax , which still I am waiting from July 2017, my regular earning around 35K on payroll and some self employed all taxes paid,
I am worried about my next extension or ILR, please someone advice me which option will be best to apply, Parent five year route, partner, or my own right 10 years,

I'm sorry but You're not correct. This is my current situation and I will be using my visitors visa towards my LR application in June. I have researched this and have seen a letter form the HO confirming that as long as residence is not broken, visitor's visa can count towards your 10 years. so the original poster is safe.

Dear Seniors,

My application for ILR on SET LR had been certified (out of county appeal)in oct 2017, I applied on window within 14 days of refusal on SET O again and they requested some documents which i have provided, that application is still pending, In DEC 2017 i challenged certification and got in country appeal which has been submitted and acknowledgement has been received.
1- Can appeal and pending application go parallel at same time?
2- Can pending application affect my appeal? My solicitor saying they will write to me and will ask to keep one. Home office can't take back appeal right now.
3- Any chance of fee refund for pending application.

I've been sitting in the home office in Croydon since 11am. It's nearly 5pm. I submitted a 10 year long residence settlement application with all required supporting documentation. I am from the USA and have been here on a combination of student and work visas since 2005 - just finished my PhD. I have less than 540 days out of the UK in the last 10 years - but only just, and only counting half days in the UK, too. I've been watching my absences carefully these last two years. They called me about a wonky stamp on my passport that makes it look like I overstayed for 19 days in 2009 but I didn't, which I mentioned in my cover letter, included a flight receipt for, and managed to explain the second time they called to tell me my application would be delayed but to wait in the waiting room. The first time they called I said I wasn't sure because I couldn't remember but then I looked at my notes and remembered. What are they doing with my application?! My electronics are all nearly out of battery, the cafe is closed and I'm very nervous they're going to refuse me.

Just want to share about our experience today @PEO Sheffield. My Mrs SET LR was approved today.

Appointment at 08.10am
We reached @ 07:30, Doors open @07:45
Security Check @ 07:50
Document taken @ Reception @ 08:00
Biometrics done 08:15
Told us it will take 1 hour to decide the application. Took our phone number to call us.
Left PEO Sheffield @ 08:20
Got call@ 09:20 We were right outside the building enjoying the sun.
ILR approved and got the documents back @09:30.


Pretty Straight forward application.
6 years student dependent,
1.5 years section 3c,
2.5 years FLR FP under Partner Route,

I made 3 sets of file.

1. Set LR form with all passports covering 10 years period including 3 British passports of my kids.
Better to edit pdf file of set lr form (make good impression in my view as compare to hand written form).

2. Original Supporting documents
Ielts B1
LIUK test
Council Tax bills last 6 years.
last 3 months joint bank statements
My last 2 P60's and 3 months payslip
Kids Birth Certificates
Marriage Certificate
Joint bank statements covering last 7 years

3. Photocopies of All above.

If u want the process to be quicker make copies of all supporting documents.

Nice and pleasant experience @ PEO Sheffield. Staff was really amazing including the security staff.

Hi all,

wondering if i could clarify a few things.
I've somehow always thought the ILR (10 year long residence route) required a leave of less than 180 days within 10 years. Must have interpreted this wrongly during my uni years.

So i would like to find out if i stand to apply for ILR in a few months time based on my circumstances

Entered uk as student tier 4 visa ( 19/09/2008 - 31-10/2012)
Extended as student for a further year from 12 to 13.
PSW was removed in 2013. Stayed on in uk as a special tier 5 visa negotiated from student in my course to do a registration.
Finished in October 2014 and left the country and reentered the uk under tier 2 in Feb 15.

Based on the above dates, does that mean i would be eligible to apply for ILR this coming September?

Any help in clarifying is much appreciated.

My embassy took my first passport ( that is the policy) when it expired.
So i will not have all my passports when i apply.
What documentations can i provide to show that i did not leave the country in the period the passport covers

I will appreciate your reply.

I think am due for the ILR thoroug the 10 years residence route, but am not sure.
Student Visa march 2008 till sep 2009.
applied as a Tier 1 Spouse Sep 2009 refused but had right of Appeal, got Discreationary leave to reamin till April 2013.

Applied for extenstion April 2013 refused for filling wrong form, but got right of appeal and it was granted as a Tier 1 Spouse till april 2016
Now on a FLR till Oct 2018, will I get ILR under the 10 year route?
am happy to explain further am just trying to keep it short.

Set(LR) does not permit dependents to apply with you. What is their current visa status and how long have they been in the UK? What is the visa status of the other parent?

Hi all,
I received my BRP on the basis of FLR(FP)/7 Years child concession category in January,18 but HO still not returned our passports and other docs. I now want to apply for indefinate leave to remain on 10 years long residence basis but don't have previous passports to submit with my application.
Can anyone please guide me. Any active phone number or Email address to request them for our passports.

My set (LR) application is refuse due to out of time application in way back 2011.
Here I have posted my PSW visa on time but file came back to me due to photograph is not as per guidelines and Home Office send me the fees back too. I then resend the file with correct photograph with in 2 days and got the visa after necessary process of biomatric after 90 days.
Now home office giving me the reason for my refusal is that from the time they send the file back till the time I got the visa there is the gap of continuity.
Hence my set ( LR) in 10 years continuous long residency route is discontinued.
Now I have the appeal hearing pending.
Please let me know how to handle this issue..
Your advice will be highly appreciated..

Hi and thanks for your response. Their dad doesn’t live here, it’s just myself and both of them. I came on a student visa in 2008 and they also got dependant visas. Since then they have been my dependants. I’m their only parent here.

Case refused because of Tax amendments in Feb 2018
JR appeal applied in March 2018

Hello all,

I will be submitting SET (LR) application in August 2018.
My visa status has been:

Sept 2008 - Feb 2011 : Tier 4 student visa
March 2011 - March 2013 : PSW
April 2013 - current : Tier 2 General (renewed once in 2016, expired in March 2019)

I have all of my previous passports during these times.

Do I need to provide any supporting document to show that I have been living in the UK continuously without gap since 2008? I'm going to submit my application using the premium service.

I wonder if anyone knows if I am eligible to apply for ILR through this 10 year long residence route with my current 'Leave to Enter' Tier 4 student visa expiring Sept 2019?

On the homeoffice website it says "You must have permission to stay ('Leave to Remain')...". On my BRP is says 'leave to enter'.

I have not broken the 180 days and 540 days away from the UK and had never overstayed. Although, I had two entries to the UK last year that was visitor visa on arrival.

Leave to remain = visas granted WITHIN the Uk.

Leave to enter = visas granted OUTSIDE the UK.

Both are the same thing.

Money was deducted on 15 March 2018
Acknowledgment e-mail received: 22 March2018
Biometrics letter received on 20/04/2018
Biometric submission on 20/04/2018
Monthly email received on 23/04 and 21/04/18 saying still under consideration
Request for upgrade submitted 23/04/18 but declined saying am not eligible for an upgrade please suggest why they have refused my upgrade request and how much time HO is taking for postal applications.

Hi,

I intend to apply for ILR next year.

my timeline:

24 september 2008 -31 december 2012: tier4
31 december 2012- 31 december 2014: PSW
applied for tier 1 on 29 december 2014 before the visa expiry date.

application refused on the 6th of March 2015 but due to problems in post, documents remained with the post office for one month and then returned to the UKBA office. I was not aware of this. I contacted home office on 16th of April 2015 to send my docs back. Received my refusal letter with the right of appeal on the 23rd of April.

Before the 23rd of April, I applied for PBS dependent visa on the 17th of April and application was withdrawn on the 6th of May. I received my passport on the airport from the home office on the 14th of May, went back to india, applied for PBS dependent visa on the 15th of May and got PBS dependent visa from 4 june 2015 till 02.02.2020.

My ten years will be finished next year. I am confused.. I had 3C leave by making an in time application and then I departed UK with no valid leave.

On one side they say 3C leave is counted towards ten years and on the other side they say, need to apply for entry clearnce within the 28 days of original visa expiry date. 3C leave is the extension of original.. will they count 28 days from the end of 3c leave or my continous residence has broken?

* UK Degree Certificate (BSc in Actuarial Science with Placement)
* 2 x Passport photos

I also submitted a covering letter detailing my application and a section on continuous residence explaining my absences from the country.

When you were at the immigration, did they ask to see your payslips / employment letters / P60 since the last few years of your stay involve paid work?

Did they ask you any other questions etc?

Hello everyone need some help of anyone could guide me plz I have applied for my child 7 year visa but that was refused now I have submitted an appeal against home office decision and after 2 months I will be eligible for 10 year LR. I want to know that while my appeal is ongoing how can I apply for indefinite after 2 months and also as I don’t have my passport or any document won’t be able to do life in the U.K. test and English test. Do I have to withdraw my appeal first and apply for indefinite can I use premium service ?
Please help
