I would be thankful if someone can help me with this Urgently.

I applied my ILR last year (Tier1 General route) on same day and got refusal due to tax issues. As I had my leave valid therefore I applied fresh application by post which is still pending with them. They call me for interview on 3rd April 2017 and waiting for the decision. Now my 10 years are completing on 6th August 2017. So, If anyone could help me with my below questions I would be very thankful to you.

1. Can I submit my new long residence application (10 years route) while pending the ILR (Tier1 General) application and interview had done.
2. If I can apply 10 years route application then how many days before I can submit it while pending previous application ( as 10 years are completing on 6th Aug).
3. Do I also need to tell them that my previous application is pending and what reason I can give why I'm sending new application? Or I just submit the new application without any reason.

I have varied my Set (LR) application from SET(FP) to SET(LR) on - 24 October 2016

MY Set (LR) timeline-

Application : SET (LR) 10 year long residence POSTAL application
Application sent: 24 October 2016
Application Received: 24 August 2016
Payment deducted: **Application Varied**
Automated emails received: Received
Acknowledgement/BRP letter received : Received on 15 November
BRP Done : 2 December 2016
Letter Received - 17 May 2017 - To complete and return attach Questionnaire, and also to provide SA302 and Tax Year Overview for the time of Tier 1 extension
Questionnaire Form, SA302's and Tax Year Overview sent - 05/06/2017
Tax Amendment Conducted for two years 2010-2011 and 2013-2014
Set (LR) approval letter received: Not Yet (still waiting for decision)
BRP received : Not Yet (still waiting for decision)

I guess all you can do now is to wait as I don't think anyone can predict UKVI decision and appeal right!

Hi applied in November 2016, UKVI sent a letter of additional 3 months when I almost clocked 6 months. I'm patiently waiting and praying.

I'm completing my 10 years first week of next month. My application SET(O) is still pending with HO and interview has done in April. My question is that can I vary my application to SET(LR), if yes then would I have to wait to complete 10 years till next month or I can apply before 28 days while pending application.

URGENT help much be appreciated.

Go for the Postal application as I am sure you won’t get the decision same day, as we have seen with the past applications, the case never been decided in a same day (mostly Self-Employed cases) and been forwarded to the Senior Case Workers.
And you don’t need to give any reason to vary the application.

Go for the Postal application as I am sure you won’t get the decision same day, as we have seen with the past applications, the case never been decided in a same day (mostly Self-Employed cases) and been forwarded to the Senior Case Workers.
And you don’t need to give any reason to vary the application.
Thanks Lad, but won't they take as negative if i don't provide the reason and can ask why I'm varing it as my interview has been done for SET(O)?

They don't ask you the reason for varying the application, couple of my friends including me varied the application from SET(O) to SET(LR), and did not mention any reason.
Here's what we wrote in out Covering Letter we sent with LR Application -
I have already applied for SET(O) Visa Application. All my documents together with my Passport and Life in the UK Certificate are already with the Home Office. As I have not had a decision on that application I would like to request for Variation of my Visa Application from SET(O) to SET(LR)
As I am varying the application, I have left the payment page blank as I have already made a payment for the Visa Fees for SET(O) form and both the fees for SET(O) and SET(LR) are same.
I originally entered the UK on (xx/xx/xxxx) on a XYZ Visa that makes me am eligible to apply for indefinite leave to remain on the basis of 10 years long residence in the UK. Whilst I have been present in the UK, I have remained as a law abiding member of the public. I have maintained good relationships with members of the community. During my residence in the UK I never made recourse to public funds and have therefore not been burdened on the state.

Vary wife's application to FLR(M), you have to pay the IHS Surcharges, plus proof of you earnings of around £18600 (without any dependant), plus 6/12 each person proofs that you are cohabiting.
And request them to hold the decision until the Main Applicant's application has been decided.

Hi all,

I am going to apply my ILR on 10 years route. Here is my immigration history.
I came in 2007 July and was on student via till 2012 December. Than I got psw which expire in december 2014. I was applied tier 4 but college was late to give me CAS letter. So I applied FLR (Fp) in december and got refused with right of appeal in feb2015. I applied for upper tribunal and got refused with right of appeal to upper tribunal. Applied to upper tribunal and got refused in October 2016 . Applied to upper tribunal for appeal of court and got refused by upper tribunal in 2017 feb. Upper tribunal send me letter to apply to court of appeal by myself in 28 to seek permission to court of appeal which I did on time before 28 days and it's still pending with court of appeal . I am going to withdraw appeal from court of appeal and trying to get premium service in Glasgow. So please friends guide me that I'm doing well .
Your help really mean to me.

Premium service is NOT an interview. A representative means nothing and has no bearing on the outcome. HO unlikely to even talk to a representative if you are present. Submit the documents the forum asks. If your documents are already somewhere with HO, you are unlikely to get a decision on your ILR on the same day, so you will be paying premium rate for an application that will take a few weeks.

1. Yes

2. Maybe, maybe not. A couple of members have not received appeal rights for refused Long residence ILR. If refused and you have no valid visa, there are very few options open to you and working will be an issue. If you get appeal rights, your section 3c protection should be fine.

Also, if your ILR fails, your dependents will have a problem if their visas have already expired. Their FLR(M) will fail if your ILR fails and they are unlikely to get appeal rights.

She cannot apply for ILR on Set(O) if you vary. She only has the option of FLR(M) which will reset her clock to zero and a new 5 year route to ILR. You will have to vary hers and ask for it to be held till your ILR decision is made.

Why do you want to vary to Set(LR)?
