Wanted to share my experience for the ILR (LR).
Applied on the 22nd of August at Croydon PEO.
Application was put on hold for further checks owing to requirement of discretion in my application.
Got a call from the Home Office today saying application has been approved on discretion.
I was very surprised by the quick turnaround by the Home Office.

From my experience, discretion is possible if the reasons are genuine and verifiable. It took me 6 months to get all the evidence I could and then apply with strong documentary evidence backing my case.

I would advice all people considering applying for ILR on discretion to spend atleast a few months building up your case before you submit your application.

Hello everyone.

I Sent my documents to home office on the 17/02/17 for my Long Residence (10 years) SET (LR) application. The first automated email from home office was received on the 17 March 2017 which mentioned that "Thank you for your application to the Home Office. Your application has been received and is being considered.
It may take up to six months to make a decision on your case ..." after that i received automated email every month. I have tried home office online tracking process to find something about my application but none of the Ref no. is working incl Royal mail tracking number.

Just need to know if someone can help me understand that if my six months period starts from the day documents are received by the home office (in my case it was received by 20/02/17) or it will start from the day i received an automated email which was 17 March 2017 ?

Any help would be great.

It is the date you submit your application or vary your application. If your 6 months has already been completed then I would recommend to send them a reminder. You know what I believe that they haven't touched your application yet based on my own experience. I varied my application in 1st week of November 2016. Used to get the email every month from H.O until I completed my 6 months wait. Waited till May 23rd then I sent them a reminder (At the same time no number/ref was working on Online status check). They responded my letter dated 2nd of June 2017( Although I received it on 13th of June) asking for some more documents which they already had with the Entrepreneur visa unit. On June 9th I checked my status once again and this time it was showing "Awaiting a Decision" for 1st time updated on June 5th. Why I am saying they started processing my application only in JUNE because I had also received my SAR to find out what is happening. In SAR I saw no data on ILR application only that It has been forwarded to ILR processing unit or some thing like that. Now I also have got my Local MP involved but seems like they don't even bother to reply them. Lets see if they are going to respond anyway. But my suggestion to you would be to chase it up.

Many here make mention of their income and taxes paid as if it is of particular significance to the application. I have completed a SET LR ILR application for my husband in June 2017. Nowhere in the application does it ask for income or employment details and so I provided none. It simply mentions you can provide NI contribution records and employers letters to show continued residence IF you are not providing the passport(s) to cover that time period.

Can anybody else confirm whether they have done a successful application without providing these details?
And what is the reason that others are providing these details when it is not required by the application form?

Because I was on Tier 1 general and they asked for all the details tax documents etc. thanks

Hey guys,

I've got a couple of questions about SET(LR) application form and appreciate your help and experience:

On the cover page under title 'DUTY TO STATE ALL REASONS TO REMAIN IN THE UNITED KINGDOM' its asks to mention all reasons in the box at the end of section 3.2. Now:
  1. Section 3.2 is just a simple yes/no question and there is no box there. Is this a typo or am I missing something?
  2. There is a box in D15 for such purpose, but before you reach there in D11 it clearly says if you're not (family of) EEA national exercising treaty rights go to section E, which means leaving D15 empty. I'm a non-EU resident and don't need to fill in this section. So, where should I give reasons? Perhaps in a separate letter?
  3. Since I'm a non-EU resident, do I need to give any reason at all? I'm starting to believe that the requirement on the cover page only refers to EEA national and they are required to give reasons, but I don't need to. Am I the only one to think this way?
Anyone had experience with this before, especially the non-EU applicants?

Hi Gurus,

I would like to clear few points on my case on ILR based 10 years continuous residence.

I came to UK in July 2008 on student visa
then PSW till 2014
then student visa again till April 2016
I got married with British Citizen in February 2016 and applied for FLR FP in April 2016 (FLR FP because we could not meet Financial Requirements due to my wife job being non-salaried)
In September 2016 varied FLR FP to FLR M
In November 2016 got refusal with out of country appeal on our FLR M stating we do not meet the FM-requirement (However, we did meet the requirement but HO calculated our income wrong).
Within a week from refusal we sent a PAP to which HO agreed to reconsider
Meanwhile I lost my job because of right to work issues.
After waiting nearly a year, in September 2017 our visa got approved which is now valid till Feb 2020.

Please, I would like to ask if there is any gap within my continuous residence of 10 years? Because my soliciter saying I cannot apply for ILR in July 2018 because there is Gap after the refusal with out of country appeal and which ended my section 3c leave.

So far i have remember e0001 should get his decision on by 24th august if i m not wrong. did u get any updates e0001?
@ legal khan , whats ur update brother? any news from home office or ur local MP?

my position hasn't been update yet...... thinking i m going to same day application. had enough and can't wait any more. its now 11 month running and everytime same old reply.

plz let us know if anyone's got any update or any other option we can try.

No news from Home office yet but got a letter from M.P stating that they have raised a query on my behalf and mentioned about my concerns, Now according to them I shouldn't contact them(MP) until 6 weeks passes. if they didn't get any response from H.O within 6 weeks then They will write again in September end means wait wait wait and wait either this way or that way.

Dear memebers
My husband has his set lr due in oct, his current status is as my spouse and he received PR in july. We have been told time covered as an Eu family memeber is covered in 10 years as long as EU national is exercising treaty rights.
Last month i changed my job and statred working for an agency where I am paid on weekly basis. I am planning to go Back home for couple weeks and wont be paid for that. Question i have is the time i am on holidays will be covered as my husband's 10 years. As we will not have payslips showing qny income for those two weeks. I am a bit scared but i have to visit back home too.
your advice will mean alot.

For the 5 months EU FM, he will need all the evidence that you are a qualified person exercising treaty rights, i.e. payslips, bank statements, evidence of cohabitation etc.

HO might also ask for some documents related to his time on Tier 1 Entrepreneur visa.

I do have payslip, evidence of pay into our joint bank account, do we need to give home office more pictures and bills as we gave for our EU spouse application?. i have changed jobs three times in last 5 months i dont think it should be a problem. This job i have at the moment is agency work and pay is weekly. Therefore i am worried that he will not be able to show wages for two weeks. Can it go agaist his application.
i dont know much details about entrepreneural visa documents, I Can ask him for more detail. What i am aware of that he was running his compnay till he received a document called "comfirmqtion of application with work allowed" from home office. After receiving that document he resigned from the company and compnay is closed now. During his entrepreneurial time his compnay was being run according to home office requirements he had 2 employees in his company and was getting payed from his company too. Our relationship is 3 years old but we got married last December. Application for residence permit was submited in January.
His entrepreneurial visa expired in May this year
