Long Residence (10 years) SET (LR) applications

Dear All,

Finally, after nearly 2 years I was granted indefinite leave to remain in the first week of October ( few weeks ago) . Throughout my ILR application, I kept on checking this forum , few posts from member did encouraged me a lot so thank you. I was on Tier 1 general and after getting frustrated I then varied my application to Long term residency.

If I look back now, It’s been a tough ride, loads of time I got very disappointed, but then again, knowing it’s nothing more I could do, I just tried to stay positive. Last few months, I contacted home office numerous times , unfortunately didn’t get any reply, I then ended up having depression. All the factors (like not able to travel, to start a new life, get myself a better job etc etc ), did affected my life and health, that was a very tough time. Luckily, I had my partner with me, she supported me through thick and thin.

From my personal experience I’ll say, No matter how strong or powerful or confident we are, tough times will come: viciously forcing their might on us, causing us to crumble. As mighty as we can feel one day, we can feel just as lost and scared the next. I don't say this to cause fear, I say it because it's the truth. The hardest part of tough times is not to lose hope and to have faith and to leave everything to God .

I came to the UK in March 2009 by student Visa. My third student visa was rejected in 2010 but I was right to appeal for this. I filled the right to appeal form and the court gave the vote to me. However, it was the mistake of home office when they were considering my case. While my case did not submit yet to the court, the home office issued my visa (they knew they did this mistake). After finishing my study, I did not work for 2 years as I was taking care of my baby. I am wondering that rejected visa in 2010 and 2 years not working can be the issue for me when I want to apply for LIR for Long Residence (10 years)?

28 days from the day u received ur invalid application back from office count the days from the date on the letter

I spoke to a solicitor and they have said to me that based on the judgement below the application might get refused as an invalid rejected application is classed as a break and that my 10 year continuous stay would be broken due to this. Is this true.

I am really worried. I've read over the judgement over and the more I read it the more worried i am. Please shed some light on this if anyone has some knowledge on this judgement or on my case with returned invalid applications.

Dont think that these lawyers are always right most of them are use less. I would say u go for ILR if u dont have money problem. if u get refused courts are there u go for appeals it takes time and u have to fight for it but in the end im sure u will get it as most of the people on this forum did.

If everyone is going to follow and understand what the instructions on the form says than your forum wouldn't be running and you wouldn't get many posts on daily basis, again, is it just previous passports along with picture and application form only?

The answer is still same . If u cant understand the instruction then u should get help from a lawyer rather then arguing with the people on this forum who are simply trying to help u.

This isn't called Help - This is called look there and you will get Help. What's the point of me posting here and asking question then?

When i applied for set lr i used

Set lr form
Pictures
Life in uk
Msc degree
And payslips of my father to show he is exercising his treaty rights in uk as i am currently dependent on my father and he is swedish national.

And list of absences from uk on seprate sheet. Case worker never asked me for anything else never asked me for any tax returns because im not on tier 1 or anyother category in which u have to show ur tax returns.

Only reason my ilr was refused is because of 62 days gap between my previous LTR applications.

Ill tell u again documents vary from case to case and they always ask for more documents if ur on tier 1 u will have to show ur tax documentation.

Hi All,
A silent reader of this forum, just a small query regarding my application. I applied for ILR (LR) on June and on November 24 2017 got a call from my solicitor that my ILR application was successfull and All my passports and documents have been returned, however it has been two weeks since my solicitor received that letter and my BRP card has still not arrived. Should I be worried because most people get their BRP within 2 - 3 days or atleast within a week why is it taking so long for me. Worried very much

My previous visa grants were, student and PSWs all together 10 years.

I am concerned because I read in this forum and also some other people I know that their BRP card arrives within 2 - 3 days, mine hasn't and it has been a 10 full working days. just worried and wondering what could have cause for my BRP to be so delayed.
I applied through postal service.

Please can you let us know why you varied your application from Tier 1 G to Long residence ILR.. did you receive a response before you did so.... because I am thinking of varying my application to 10 year long residence..After being through an appeal with previous tier 1 application in 2013, I don’t have the time to be chasing adults in HO up and be emotionally stressed I am considering to vary my Tier 1 G 5 year route to 1 day ILR 10 year residence so your advice would be greatly appreciated.

Hi everyone,

I just need advice, I am going to apply ILR for my wife, she have 13 year in UK but still main applicant myself do not have ILR, my daughter is British National and son got ILR, and little daughter British born and 6 and half years old,
I have submitted missing tax return from my accountant but not heard from HMRC, my wife has completed her 10 year legal, Any impact on dependent application of my main applicant tax amendment.
Your advice and thoughts will be really appreciate,

Applied 10 years based ILR in January 2016 couple of months before completing 10 years.

Applied for ILR: ------ Jan/2016
Refusal based on early application (with right of appeal): ------ May/2016
Appealed against refusal: ------ 06/2016
Attended hearing: ------ 23/3/2017
Appeal refused but futher appeal rights given:-------04/2017

Applied fresh application set (lr):-------05/2017
Biometrics done:------06/2017
received letter from HO saying Fee page is missing. fill the fee form and send it back within 10 days:-------17/10/2017

Ilr got 11/12/2017.

Hi Experts,

I need some guidance on my ILR. I am in a very difficult situation . I am on a ICT Tier-2 visa and first landed in UK in July 2008 on a Work Permit. There after my employer sent me back to India in Dec 2012 and my new visas were issued in March 2013 with a gap of more than 28 days from the previous visa. So my clock started again. However, I will be completing 9.8 years in February 2018 and will be short of 4 months for ILR.

I met few solicitors and they said that in this situation, I should apply for ILR via Post in Feb 2018. As per them, the Home office will usually take 5-6 months to process my application and by that time, I would have completed my 10 years and will get ILR.

It is not that I do not trust my solicitor but wanted to know your thoughts and opinion.

1. Will the postal application work in my case and be considered?
2. Can I legally work during this period?
3. Is the 28 day gap between two visas applicable for a 10 year route ILR?
4. Anything that I should be aware off?
5. Is FLRO visa an option?

Sorry for so many questions but I am very confused at the moment. Your help will be much appreciated.

Is ur case complex or any tax issues.? For straight cases they take 3 months or lil bit more. Wat was the reason of refusal

Hi all,

I just wanted to post to let you know of my recent success story with the postal application for ILR done via the long residence route. I initially wanted to do a premium appointment for a quick decision but due to no available appointments, I opted for the postal route in the hope that I can request to be upgraded for a premium service. I was not so lucky as I was told that my application was not eligible for an upgrade and therefore became stuck with the postal route.

A few days ago, I found out my ILR application has been successful and below is my timeline:

Postal application sent: 18 September 2017
Payment deducted: 25 September 2017
Biometrics requested: 29 September 2017
Biometrics done: 4 October 2017

*In early december, my solicitor and I tried to get in touch with the home office a few times to find out regarding my application. I actually wanted to withdraw as I found a premium service appointment in January 2018 and was getting desperate for a quicker decision. The home office later called to let my solicitor know that my application was nearing a decision and that we should wait further before withdrawing.

Letter received from Home office regarding success of application: 10 December 2017
BRP received: 13 December 2017

I had a straight forward case with the majority of my stay covered under Tier 4 student visa and also a post study work visa. I also kept all my bank statements for the past 10 years and provided as much documentations as I can with the application. To be honest, I am very pleased with how quickly I received a decision from the home office. Hearing from everyone else's experience, I think I had a relatively short wait of under 3 months via the postal application and consider myself very lucky. I wish everyone else all the best and hope that sharing this timeline will be helpful to some of you.

She has to qualify in her own right. Your situation is irrelevant to her ILR LR application.

I don’t think it will take 6 months as there were people on the group who had same situations but they got call within 1 month that they get the visa so hopefully you will get good news.
I am going on 29 December so please share your list of documents they asked ?
I got one more questions that did you not know that they ask for the documents as we had discussions that they always ask ?

I knew about this but my friends have advised and some of them applied without providing a single document from Tier 1 as according to them in Long residence it doesn't matter what visa you were on as long as you living legally... I found strange when the case worker asked me all this....

Below are the points that HO asked to provides documents for, hope this is help for everyone but make sure these are case dependent so you got addition information include it in your file:

the following information/documents as stated below -1. Please advise us and submit the appropriate evidence to demonstrate that you have done one of the following things within 6 moths from the grant of leave -
(i) registered with HM Revenue and Customs as self-employed,
(ii) registered a new business in which you are a director, or
(iii) registered as a director of an existing business
2. Please advise us if you have set up a business as stated in your Tier 1 Entrepreneur application and if so, please submit us the relevant details in its support for our reference.
3. Please advise us if the funds referred to in your Tier 1 Entrepreneur leave to remain application are continued to be available to you, except where they have been spent for the purposes of your business or businesses and submit the relevant evidence in its support.
4. Please advise us if you are currently in employment outside your own business.
5. Please submit us your bank statements since grant of leave to remain as a Tier 1 Entrepreneur migrant to demonstrate that you have been maintaining yourself and dependant family, if any, in the UK without recourse to public funds.

I varied application because of the endless wait on Tier 1 g application , i didn't had any refusal . Hope it helps
