Switching from T2 ICT to T2G

Hi there,

Brief background:
Me and my wife both working in UK. My wife is on ICT short term visa and I am on ICT long term visa. Previously I was having ICT short term visa.
Can I switch my ICT long term visa to ICT short term dependent visa on my wife and start work for another employer in UK if I got sponsored. then after the completion of my ICT short term dependent visa can I apply for T2G.

As long as you hold a PBS dependent visa for 12 months, then you can apply for Tier 2 G from your home country if you meet all the requirements and the full and proper RLMT process has been completed.

Thanks. So switching from ICT LT to ICT ST dependent could be done in UK only or I have to go back to my home country.
Objective behind all this is- I got a job sponsored by new employer in UK since i am on ICT LT, i can not apply T2G without serving cool off period. So i am planning to switch my visa status as dependent to avoid cool off period and then apply for T2G from home country and then after 5 years will apply for PR.

So, can i switch from ICT LT to ICT ST PBS dependent any time with in ICT ST tenure?
Can i then immediately apply for T2G i.e. Immediately after switching into ICT ST dependent?

You can apply for Tier 2 ICT ST dependent WITHIN the UK.

You will have to wait 12 months from date of dependent visa before can apply for Tier 2 General from home country.

There is no way that you can avoid the 12 month cooling period.

Yes. Make her sponsor carries out RLMT properly and issues a Restricted CoS. Your wife needs to apply for Tier 2 G Visa from her home country
Q4: Can I then convert my ICT long term to T2G dependent visa on her?
Yes
Q5: Can T2G dependent work here in UK?
Yes
Q6: After all above can we both get permanent here in UK after T2G?
Yes, You can apply for ILR after 5 years stay with T2G visa.

The only way I can think of is getting your spouse a T2G visa and then switching your status as her dependent.

Cooling off period doesn't apply for dependent visa AFAIK

There is no cooling off but you still have to stay for 12 months on the T2G dependent visa before applying for T2G as the main applicant.

The cooling off period starts from end of ICT Long term to the beginning of T2G Main. In this 12 month interval you can freely work as a T2G dependent of your spouse and even continue working on the dependent visa after 12 months

*IF* you decide to apply for a T2G Main applicant visa, then you can only do 12 months after ICT LT has ended and the application has to be made from home country.

And regarding answer 3 and 4 from ravi in below msg. I am confusing.
Q3: Can my wife switch long term dependent into t2g if she gets the sponsor?
Q:4 can i then convert my ICT LT into T2G dependent?

ICT LT is of 3 years, so in Q3 she have to switch into T2G before the completion of ICT LT dependent. And in Q4 I have to then apply for T2G dependent with in the ICT LT main tenure.
So how gonna things work out as far as cooling off is concerned..?

If your spouse applies from home country for Tier 2 General, her ICT dependent visa is cancelled.

If she gets Tier 2 General and returns to the UK and you switch to Tier 2 General dependent, your Tier 2 ICT visa is cancelled, regardless of how long is left on the visa.

If you get a Tier 2 General dependent visa granted on 1st July 2016(for example), then the earliest you can apply from home country for Tier 2 General is 1st July 2017. You HAVE to spend 12 months on dependent visa status before you can apply for Tier 2 General.

For ICT LT - After reaching home country Is there any time duration in which I have to apply for ICT long term. I mean Is it fine if I apply for ICT long term after few month (say 3 months) after reaching home country. For eg: My ICT short term visa expires in July 2016, so Can I apply for ICT long term in Oct end from home country?
Is there any issue with that?

And similar case with ICT LT dependent.my spouse was in ICT ST dependent previously but she spent only 3 months in UK and then returned back to India. Can she also apply for ICT LT dependent with me in Oct end?

Some how I manage another way to get T2G.
Please help me on below:
As you know that I am on ICT short term visa and I can not switch to T2G. So I have asked my employer for ICT Long term immediately after ICT short term, Which I conclude from your guidance that its possible without any cooling off and I just need to apply from my home country. So what I am planning to do is - I come back UK on ICT Long term visa and bring my wife on ICT long term dependent visa. Then my wife would get sponsor here in UK and can switch to T2G. I will then switch my status from ICT long term to T2G dependent to her. So we both can be permanent here.

Its bit of story line up but this is how I am thinking to get job here.

Do you really want to spend 10 years of your life struggling to get hold of a UK ILR or do you want to plan better and move to a country which is more immigrant friendly and lets you settle there in less than 5 years?
Why don't you simply look at options for moving to Australia or Canada instead ? Both these countries are safer and better than the UK in many ways.

I don't mean to discourage you but if you haven't noticed already UK is getting immigrant unfriendly and extremely unsafe. The laws continuously keep changing year after year to prevent skilled people getting ILR or UK nationality. The lucky ones who made it came to the UK between early 2000's and early 2010 and were able to settle in alright. After mid 2010, a lot has changed , making it tougher and tougher.

I'm confused!

In earlier posts, you told you already have ICT LT visa. Now, you are asking if you want to apply for LT visa from home country. What really is the case?

To answer your query, there is no defined timeframe and you can apply for the ICT LT visa on the next day itself after landing in your home country.
